٨٣ - وأضافت قائلة إن العقوبات المذكورة في الفقرة ١٠٨ من التقرير، والمفروضة على عدم دفع نفقة الطفل في حاجة إلى إيضاح، حيث أنها تبدو غير متسقة مع حظر حبس أى إنسان لمجرد عجزه عن الوفاء بالتزام تعاقدي بمقتضى المادة ١١ من العهد.

All contractual obligations in the Sudan are governed by the Civil Transactions Act, and whenever there is a dispute pertaining thereto, such dispute is conducted in accordance with the Civil Procedures Act 1983; therefore, no one would be imprisoned merely on the ground of inability to fulfil a contractual obligation.

The Estonian Constitution also includes the spirit of this article: no person may be deprived of his or her liberty solely on the ground of inability to fulfil a contractual obligation (art. 20, EC).

Giving due consideration to article 11 of ICCPR, according to which no one shall be imprisoned merely on the ground of inability to fulfil a contractual obligation, Grenada should provide the HR Committee with information clarifying the meaning of this term and ensure the full implementation of article 11.
وقالت إنه ينبغي لغرينادا أن تقوم، مع التقيد على النحو الواجب بالمادة 11 من العهد الدولي الخاص بالحقوق المدنية والسياسية التي تنص على عدم سجن أي شخص لمجرد عجزه عن الوفاء بالتزام تعاقدي معين، بتزويد اللجنة بمعلومات توضح معنى هذا التعبير وبكفالة تطبيق المادة 11 من العهد تطبيقاً كاملاً(49).
