The HR Committee was concerned that article 160 of the Penal Code employed an overly broad definition of trafficking that included lesser crimes, complicating the assessment of the extent of prosecution, conviction and sentencing of trafficking offenders.

The Committee is however concerned that article 26 of Act No. 16/1960 (the Penal Code) provides for the right of a person to discipline a child, if that person is authorized by law to do so, on the condition that boundaries are maintained and the intention of the beating is directed solely towards disciplining, and that corporal punishment remains lawful in home and in alternative care settings.

It is further concerned that article 15 of the Constitution permits derogation from article 15 of the Covenant, which is non-derogable, by making it possible to impose restrictions on the freedom from retroactive punishment (article 13, paragraph 6, of the Constitution).

While welcoming that the definition of a child in Guinea, contained in the Children's Code, is in line with the Convention and the fact that the minimum legal age of marriage is now fixed at 18 years for both boys and girls, the Committee is concerned that article 269 of the Children's Code allows the marriage of boys and girls under 18 years, with the consent of their parents or legal guardians.
33- في حين ترحّب اللجنة يكون تعريف الطفل في غينيا، كما ورد في قانون الطفل، يتماشى مع الاتفاقية، وبتحديد السن القانونية الدنيا للزواج في 18 سنة للفتيان والفتيات على حد سواء، تعبّر اللجنة عن قلقها لأن المادة 269 من قانون الطفل التي تتيح الزواج للفتيان والفتيات دون سن الثامنة عشرة بموافقة الوالدين أو الأوصياء القانونيين.

12. CEDAW expressed concern that section 15(4) of the Constitution exempted adoption, marriage, divorce, burial and devolution of property on death and other matters of personal law from the constitutional provision of non-discrimination.
