وينبغي ألا يحاكم الأطفال على جرائم الحرب أو الجرائم المرتكبة ضد الإنسانية؛ وتطبق قواعد بيجين على الجرائم الأقل خطورة.

Article 14 of the Beijing Rules provides that the proceedings should be conducted in an atmosphere of understanding to allow the child to participate and to express himself/herself freely.

In addition, the Convention called for the implementation of the most conducive provisions for the realization of the rights of the child, and had therefore to be considered in conjunction with other relevant international instruments, namely the Beijing Rules, the Riyadh Guidelines and the Rules for the Protection of Juveniles Deprived of their Liberty.

Fundamental Act 4/1992 was drafted on the basis of the rights recognized in the Convention and the recommendations of other international texts, such as the Beijing Rules, which apply to minors between the ages of 12 and 16 years.
