5- حماية الحقوق: ويُقصد بذلك أن تحمي الدول الأطراف بفعالية أصحاب الحقوق من أي انتهاكات لحقوقهم الاقتصادية والاجتماعية والثقافية، تشارك في ارتكابها أطراف فاعلة من الشركات، من خلال سنّ قوانين ونُظم ملائمة، واتخاذ إجراءات للرصد والتحقيق والمساءلة بغية وضع وإنفاذ معايير لأداء الشركات.
