`1` أن تحذف أو تعدّل أيَّ جانب من الخصائص التقنية أو النوعية للشيء موضوع الاشتراء، المنصوص عليها في البدء، ويجوز لها أن تضيف خصائص أو معايير جديدة تتوافق مع مقتضيات هذا القانون؛

The 2011 text prohibits any description of the subject matter of the procurement that may restrict the participation of suppliers or contractors in or their access to the procurement proceedings, including any restriction based on nationality.
ويمنع نصّ عام 2011 إدراج أيِّ وصف للشيء موضوع الاشتراء يمكن أن يقيِّد مشاركة الموَرِّدين أو المقاولين في إجراءات الاشتراء أو سبل وصولهم إليها، بما في ذلك أيُّ تقييد يستند إلى الجنسية.

The availability of multiple procurement methods allows States to tailor the procurement procedures according to the subject matter of the procurement and the needs of the procuring entity.
فتوافر طرائق اشتراء متعددة يتيح للدول أن تصوغ إجراءات الاشتراء تبعاً للشيء موضوع الاشتراء ولاحتياجات الجهة المشترية.

In addition, there will be no meaningful competition where the auction effectively ceases to be based on a common description of the subject matter of the procurement.

The economic benefits of framework agreements will be realised where they are used to satisfy the procuring entity's needs for the subject matter of the procurement.
10- وستتحقّق فوائد الاتفاقات الإطارية عندما تُستخدم لتلبية احتياجات الجهة المشترية للشيء موضوع الاشتراء.

(i) deleting or modifying any aspect of the technical or quality characteristics of the subject matter of the procurement initially provided, and adding any new characteristic that conforms to the requirements of this Law;
`1` حذف أو تعديل أيِّ جانب من الخصائص التقنية أو النوعية للشيء موضوع الاشتراء المنصوص عليها في البدء، وإضافة أيِّ خصائص جديدة تتوافق مع مقتضيات هذا القانون؛

After subsequent discussion, it was agreed that no definition of the subject matter of the procurement should be included in the Model Law.
27- واتُّفق، بعد مناقشة لاحقة، على عدم إدراج تعريف للشيء موضوع الاشتراء في القانون النموذجي.

(a) Where it is feasible for the procuring entity to formulate a detailed and precise description of the subject matter of the procurement;
(أ) عندما يمكن عملياً للجهة المشترية أن تصوغ وصفا مفصلا ودقيقا للشيء موضوع الاشتراء؛

(ii) Delete or modify any criterion for examining or evaluating tenders initially provided, and may add any new criterion that conforms to the requirements of this Law, to the extent only that the deletion or modification is required as a result of changes made in the technical or quality characteristics of the subject matter of the procurement;
`2` أن تحذف أو تعدّل أيَّ معيار لفحص العطاءات أو تقييمها منصوص عليه في البدء، كما يجوز لها أن تضيف أيَّ معايير جديدة تتوافق مع مقتضيات هذا القانون، على أن يقتصر ذلك على الحالات التي يكون فيها ذلك الحذف أو التعديل لازما بسبب ما أُدخل من تغييرات على الخصائص التقنية أو النوعية للشيء موضوع الاشتراء؛

(b) The description of the subject matter of the procurement and all other terms and conditions of the procurement established when the framework agreement is concluded;
(ب) وصفٌ للشيء موضوع الاشتراء وسائر أحكام وشروط الاشتراء التي حُددت عند إبرام الاتفاق الإطاري؛

Some inconsistency between certain language versions and the English version of the text was noted, in particular as regards the reference to the feasibility of formulating a description of the subject matter of the procurement.
130- لوحظ وجود شيء من عدم الاتساق بين صيغ لغات معيّنة والصيغة الإنكليزية للنص، ولا سيما فيما يتعلق بالإشارة إلى إمكانية صياغة وصف للشيء موضوع الاشتراء.

(b) Subparagraph (d) now refers to the " detailed description " of the subject matter of the procurement required by article 10 of the 2011 text [**hyperlink**];
(ب) وأصبحت الفقرة الفرعية (د) تشير إلى " وصف مفصّل " للشيء موضوع الاشتراء، وفقاً لأحكام المادة 10 من نص قانون 2011 [**وصلة تشعُّبية**]؛

The procuring entity may only refine aspects of the description of the subject matter by deleting or modifying any aspect of the technical, quality or performance characteristics of the subject matter of the procurement initially provided and adding any new characteristics that conform to the requirements of the Model Law.
لكن يجوز للجهة المشترية فقط أن تحسِّن من جوانب وصف الشيء موضوع الاشتراء بحذف أو تعديل أيِّ جانب من الخصائص التقنية أو النوعية أو الخصائص المتعلقة بالأداء للشيء موضوع الاشتراء، المنصوص عليها في البدء، وإضافة أيِّ خصائص جديدة تتوافق مع مقتضيات القانون النموذجي.

1. (a) The pre-qualification or pre-selection documents, if any, shall set out a description of the subject matter of the procurement;
1- (أ) تُضَمَّنُ وثائقُ التأهيل الأوَّلي أو وثائقُ الاختيار الأوّلي، إن وُجدت، وصفاً للشيء موضوع الاشتراء؛

(a) It is feasible for the procuring entity to formulate a detailed description of the subject matter of the procurement;
(أ) عندما يمكن عملياً للجهة المشترية أن تصوغ وصفاً مفصَّلاً للشيء موضوع الاشتراء؛

The solicitation documents may solicit proposals relating to the technical, quality or performance characteristics of the subject matter of the procurement, as well as to contractual terms and conditions of supply and, where relevant, the professional and technical competence and qualifications of the suppliers or contractors.
ويجوز أن تلتمس وثائق الالتماس اقتراحات بشأن الخصائص التقنية أو النوعية أو الخصائص المتعلقة بالأداء للشيء موضوع الاشتراء، وبشأن أحكام وشروط التوريد التعاقدية، وكذلك معلومات عن كفاءة المورِّدين أو المقاولين المهنية والتقنية ومؤهّلاتهم، حيثما كانت لها صلة بالموضوع.
