5.1 On 9 March 2011, the author submits that the State party provided no explanation as to why the criminal investigation, opened on 2 January 1995 and which was still ongoing in 1997, was than stalled until 16 March 2001 when it was transferred to another police precinct.

3.3 The author further claims that that the proceedings before the Croatian courts were not conducted within a reasonable time and no explanation was provided by the State party to justify the overall length of the proceedings.
3-3 ويدعي صاحب البلاغ كذلك أن الإجراءات المعروضة على المحاكم الكرواتية لم تُدرس في غضون فترة زمنية معقولة وأن الدولة الطرف لم تقدم أي تفسير لتبرير طول الفترة الإجمالي للإجراءات.

6.4 The Committee notes that the author has not provided any explanation regarding her motives for her voluntary departure to Mexico.

Noting also that the State party has not provided any explanation for the delay or presented any factors by which the delay could be attributed to the author, the Committee considers that the facts disclose a violation of article 14, paragraph 3 (c).

In light of the Committee's jurisprudence, and considering that the State party has not provided any explanation for the repeated postponements and the delay in proceedings, a delay of almost six years must be considered unreasonable and in violation of the right to an effective remedy in cases of torture.

5-2 وفيما يتعلق بمدة الإجراءات المعروضة على المحكمة المحلية في زغرب، يشير صاحب البلاغ إلى أن الدولة الطرف لم تقدم أي تفسير يبرر طول الفترة الإجمالي للإجراءات التي امتدت إلى حوالي ثمانية أعوام.

6.4 As regards the author's claims relating to article 14, paragraph 1, of the Covenant, the Committee observed that the author had not provided any explanation on how her nephew's right under this provision were violated.
