وقد يتعلق هذا النوع من المساعدة فعلا بحالات معقّدة، عندما يُطلب من شخص يقضي عقوبة في الدولة متلقية الطلب أن يكون شاهدا في الدولة الطالبة.

That is, a requested State does not need to have a domestic tax interest in obtaining the requested information for the obligation to supply information under paragraph 1 to apply.
أي أنه لا ينبغي بالضرورة أن تكون للدولة متلقية الطلب مصلحة ضريبية محلية في الحصول على المعلومات المطلوبة لكي ينطبق عليها الالتزام بتوفير المعلومات بموجب الفقرة 1.

وإذا تعذر على الدولة متلقية الطلب التقيد بشرط السرية فعليها أن تبادر بلا إبطاء إلى إبلاغ الدولة الطالبة بذلك.

In such a case, the requested State shall consult with the requesting State to determine if the assistance can still be given subject to such terms and conditions as the requested State deems necessary.

3. 3- بناء على طلب من دولة طرف مستقبلة، يتعين على الدولة الطرف متلقية الطلب أن تتحقق دون إبطاء لا مسوّغ له أو غير معقول مما اذا كان الشخص الذي هو ضحية للاتجار بالأشخاص من مواطنيها، أو كان له حق الاقامة الدائمة في اقليمها وقت دخوله الى اقليم الدولة الطرف المستقبلة.
