91. The family pension is determined as a percentage of the old-age or disability pension which the beneficiary would or did receive at the time of his death.

89. The right to family pension may be exercised by the family members of a deceased beneficiary who has had a contributory period of at least 5 years or at least 10 years of pensionable service, or met the conditions for an old-age or disability pension, or family members of a deceased beneficiary of an old-age or disability pension or the right on the basis of remaining working capacity.
89- ويمكن أن يمارس الحق في معاش الأسرة أفراد أسرة مستفيد متوفي له مدة اشتراك لا تقل عن 5 سنوات أو خدمة مستحقة للمعاش لا تقل عن عشر سنوات أو استوفى بشروط معاش الشيخوخة أو العجز، أو أفراد مستفيد متوفي بمعاش الشيخوخة أو العجز أو الحق على أساس قدرة العمل المتبقية.

family pension is calculated as an old-age or disability pension that an insuree could have claimed at the moment of death and in the percentage that is calculated on the basis of number of the family members who can claim that right.
591- ويُحسب معاش الأسرة بنفس طريقة حساب معاش الشيخوخة أو معاش العجز الذي يكون بإمكان المؤمن عليه المطالبة به قبل الوفاة، وبالنسبة المئوية المحسوبة وفقاً لعدد أفراد الأسرة الذين يجوز لهم المطالبة بهذا الحق.

A widow will acquire a family pension: if she turns 45 years of age before the death of her husband or if, before the death of her spouse or within one year from his death, she becomes unable to work or if, after the death of her spouse, she is left with one or more children who are entitled to a family pension and, as a widow, she performs parental duties with respect to those children.
90- ولكي يستحق أفراد الأسرة معاش الأسرة لا بد من توافر اشتراطات خاصة، فالأرملة تستحق معاش الأسرة إذا بلغت 45 سنة من العمر قبل وفاة زوجها بولد أو إذا أصبحت غير قادرة على العمل قبل وفاة زوجها أو خلال سنة بعد وفاته، أو إذا تركت بعد وفاة زوجها بولد أو أكثر يستحق معاش الأسرة، أو إذا كانت كأرملة تؤدي واجبات الأمومة تجاه هؤلاء الأطفال.
