The Court invoked Article IV § 1 of the Convention which requires that the request for recognition and enforcement of an award must be accompanied by the duly authenticated original or a duly certified copy and by the original arbitral agreement or a duly certified copy thereof.

The State party recapitulated its earlier arguments, summarised in paragraph 4.2 above and added that under article 66 of the Law " On Notaries " , a notary attests to the authenticity of a copy of a document's duplicate, provided that the duplicate itself was either duly attested by a notary or issued by the same entity that produced the original document.

The view was expressed that, while article IV (1) (a) of the New York Convention permitted the use of a " duly certified copy " in seeking recognition and enforcement of an arbitral award, that notion might not be adequately dealt with in the draft convention.

Other courts have granted enforcement despite the fact that the applicant had not provided a duly authenticated original award or the original arbitration agreement (or a duly certified copy thereof).

Article IV(1) lists two items that the applicant should supply to the enforcing court in order to have the award recognized and enforced: the duly authenticated original award (or a duly certified copy) and the original agreement referred to in article II (or a duly certified copy).

Article IV(1)(a) requires the applicant to provide either " the duly authenticated original award " or " a duly certified copy thereof " .

As per Article IV (1) NYC, the plaintiff was to submit the following: (a) the duly authenticated original award or a duly certified copy thereof, and (b) the original agreement referred to in article II NYC or a duly certified copy thereof.

The Supreme Court noted that under Article IV(1)(b) NYC, as well as Article 105(2) of the Civil Procedure Act, the party applying for recognition and enforcement shall, at the time of the application, supply the original arbitration agreement or a duly certified copy thereof.

The view was also expressed that clarification might be required as to how the functional equivalent of a " duly authenticated original award " or a " duly certified copy " under article IV(1)(a) of the New York Convention would be provided under the draft convention.

Article IV(1)(b) provides that, in order to obtain recognition and enforcement, an applicant must also submit to the enforcing court " the original agreement referred to in article II or a duly certified copy thereof " .

Pursuant to article IV(1), an applicant seeking recognition and enforcement of an award is required to supply the enforcing court with two documents: the duly authenticated original award (or a duly certified copy) and the original agreement referred to in article II (or a duly certified copy).
5- وعملاً بالمادة الرابعة (1)، يُشترط على مقدِّم الطلب الذي يلتمس الاعتراف بقرار التحكيم وتنفيذه أن يوافي محكمة التنفيذ بوثيقتين: قرار التحكيم الأصلي مصدَّقاً عليه [موثَّقاً] حسب الأصول (أو نسخة منه معتمدة [مُصدَّقة] حسب الأصول) والاتِّفاق الأصلي المشار إليه في المادة الثانية (أو صورة منه معتمدة حسب الأصول).

To this end, persons nominated by the union or association must submit to the Ministry of Labour and Social Security: (a) a duly certified copy of the record of the constituent assembly, in accordance with the provisions of articles 213 and 214 of the Code; (b) two copies of the union's or the association's statutes, with a certified copy of the record of the meeting or meetings at which they were approved.

The Questionnaire invited States to provide information on whether any legislative provisions, rules of court or regulations stated the conditions under which the requirement in article IV (1) of the Convention that an applicant supply " the duly authenticated original award or a duly certified copy thereof " would be fulfilled.
