وعملاً بالفقرة 1 من المادة 108 من النظام الداخلي للجنة، يجوز للجنة عبر مقررها المعني بالشكاوى الجديدة والتدابير المؤقتة، في أي وقت بعد تلقي الشكوى، أن توجه طلباً إلى الدولة الطرف المعنية لكي تتخذ ما تراه اللجنة ضرورياً من تدابير مؤقتة لتفادي أي ضرر لا يمكن جبره قد يلحق بضحية أو ضحايا الانتهاكات المدعاة.
