In cases regarding the determination of criminal charges against individuals or of their rights, as well as their obligations in a suit at law, article 14 (1) of the Covenant establishes the right to a fair and public hearing by a competent, independent and impartial tribunal established by law.

9.3 As to the author's claim that the lack of an oral hearing during the appeal proceedings violated his right to a fair and public hearing under article 14, paragraph 1, the Committee has noted the State party's argument that the author could have requested an oral hearing before the Administrative Court and that, failing this, he had waived his right to such a hearing.
