The ILO representative underlined two aspects of the draft principles prepared by the Special Rapporteur: consultation and participation.
وأكدت ممثلة مكتب العمل الدولي على وجهين من مشروع المبادئ العامة الذي أعدته المقررة الخاصة وهما: التشاور والمشاركة.

In this regard, principle 13 of the draft principles governing the administration of justice through military tribunals states that military judges should have a status guaranteeing their independence and impartiality, in particular in respect of the military hierarchy.
وفي هذا الصدد، ينص المبدأ رقم 13 من مشروع المبادئ التي تحكم إقامة العدل عن طريق المحاكم العسكرية على أن يُكفل للقضاة العسكريين مركز يضمن استقلالهم وحيادهم، ولا سيما في مواجهة التسلسل الهرمي للقيادة.

5. Paragraph 16 of the draft principles and guidelines bears a considerable similarity to article 27 of Convention No. 169, which reads as follows:
٥- والفقرة ٦١ من مشروع المبادئ العامة والتوجيهية مماثلة بدرجة كبيرة للمادة ٧٢ من الاتفاقية رقم ٩٦١ التي تنص على ما يلي:

Article 10 of the draft principles might run the risk of privatizing justice by allowing companies to conduct investigations on matters that should be resolved by an independent judicial entity;
قد تفضي المادة 10 من مشروع المبادئ إلى خطر خصخصة القضاء بسماحها للشركات بإجراء تحريات بشأن أمور ينبغي أن يفصل فيها كيان قضائي مستقل؛

It also requested the Executive Director to continue supporting the programme of work of the Advisory Group of Experts on Decentralization and strengthening of local authorities and recommended that the Advisory Group should also assist the Executive Director in advising those countries that may wish to implement elements from the draft guidelines.
كما يطلب إلى المديرة التنفيذية أن تواصل دعم برنامج عمل فريق الخبراء الاستشاري المعني باللامركزية، وأن تقوي السلطات المحلية، ويوصي بأنه ينبغي للفريق الاستشاري أيضاً أن يساعد المديرة التنفيذية في تقديم المشورة للبلدان التي قد ترغب في تنفيذ عناصر من مشروع المبادئ التوجيهية.

The rights of patients to accessible and equal medical care, to the safety and effectiveness of such care, and to respectful treatment by medical and other service personnel are all enshrined in article 16 of the draft principles.
وتنص الماد 16 من مشروع المبادئ على حق المرضى في الحصول على رعاية طبية تكون متساوية وآمنة وفعالة، وفي الحصول على معاملة تتسم بالاحترام من قِبل الموظفين الطبيين وغيرهم.

443. The provisions of article 67 of the draft principles stipulate that any healthrelated intervention may only take place with the free and conscious consent of the person concerned.
443- وتنص أحكام المادة 67 من مشروع المبادئ على عدم إجراء أية عملية خاصة بالصحة إلا بموافقة الشخص المعني بحرية وعن علم.

It also noted that the report of Mr. Decaux containing an updated version of the draft principles would be submitted to the Commission at its sixty-second session for its consideration.
ولاحظت اللجنة أيضاً أن تقرير السيد ديكو الذي يتضمن نسخة محدَّثة من مشروع المبادئ سيقدم إلى اللجنة في دورتها الثانية والستين لكي تنظر فيه.

Mr. Decaux then referred to paragraph 36 of the draft principles and guidelines and noted that not all terrorist acts could be characterized as war crimes or other violations of international humanitarian law.
ثم أشار السيد ديكو إلى الفقرة 36 من مشروع المبادئ والتوجيهات وأعرب عن رأيه بأن الأعمال الإرهابية لا يمكن اعتبارها جميعا جرائم حرب أو غير ذلك من انتهاكات القانون الإنساني الدولي.

8. UNESCO furthermore proposed that it would be the appropriate body to undertake the " comprehensive annual report " described in paragraph 55 of the draft principles and guidelines contained in the final report of the Special Rapporteur.
٨- وبينت اليونسكو كذلك أنها ستكون أنسب هيئة لوضع " التقرير السنوي الشامل " المعروض في الفقرة ٥٥ من مشروع المبادئ العامة والتوجيهية الوارد في التقرير النهائي للمقررة الخاصة.

6. Paragraph 18 of the draft principles is similar to article 28 of Convention No. 169, except that it does not provide as well for these peoples to attain fluency in the national language as well as their own indigenous language.
٦- وتشبه الفقرة ٨١ من مشروع المبادئ المادة ٨٢ من الاتفاقية رقم ٩٦١ فيما عدا أنها لا تنص أيضا على وجوب تمكين هذه الشعوب من الوصول إلى الطلاقة في اللغة الوطنية فضلا عن لغتهم اﻷصلية.

7. Paragraph 49 of the draft principles and guidelines reflects the provisions of article 31 of Convention No. 169, except that it is restricted to mass media while the Convention addresses all means of education and communication.
٧- وتعكس الفقرة ٩٤ من مشروع المبادئ العامة والتوجيهية أحكام المادة ١٣ من الاتفاقية رقم ٩٦١ فيما عدا أنها تقتصر على وسائط اﻹعلام بينما تعالج الاتفاقية جميع وسائل التعليم والاتصال.

12. Notes that the report of Mr. Decaux containing an updated version of the draft principles will be submitted to the Commission at its sixtysecond session for its consideration;
12- تلاحظ أن تقرير السيد ديكو الذي يتضمن نسخة محدَّثة من مشروع المبادئ سيقدم إلى اللجنة في دورتها الثانية والستين كي تنظر فيه؛

3. Expresses its appreciation to Mr. Decaux for having submitted, in time for the Sub-Commission’s consideration at its fifty-seventh session, an updated version of the draft principles;
3- تعرب عن تقديرها للسيد ديكو لقيامه في الوقت المناسب بتقديم نسخة محدَّثة من مشروع المبادئ لكي تنظر فيها اللجنة الفرعية في دورتها السابعة والخمسين؛

In line with the Basic Principles on the Independence of the Judiciary, principle 1 of the draft principles governing the administration of justice through military tribunals stipulates that military tribunals, when they exist, may be established only by the Constitution or the law, respecting the principle of the separation of powers.
وتمشيا مع مبادئ الأمم المتحدة الأساسية بشأن استقلال السلطة القضائية، ينص المبدأ رقم 1 من مشروع المبادئ التي تحكم إقامة العدل عن طريق المحاكم العسكرية، على أنه لا يحوز إنشاء المحاكم العسكرية، حال وجودها، إلا بموجب الدستور أو القانون، وباحترام مبدأ الفصل بين السلطات.

In its resolution 2005/33 entitled " Independence and impartiality of the judiciary, jurors and assessors and the independence of lawyers " , the Commission also took note of the above report and noted that the report of Mr. Decaux containing an updated version of the draft principles would be submitted to the Commission for consideration at its sixty-second session.
كما أحاطت لجنة حقوق الإنسان علماً، في قرارها 2005/33 المعنون " استقلال ونزاهة القضاة والمحلفين والخبراء القانونيين واستقلال المحامين " ، بالتقرير المذكور أعلاه ولاحظت أن تقرير السيد ديكو الذي يتضمن نسخة محدّثة من مشروع المبادئ سيقدم إلى اللجنة كي تنظر فيه خلال دورتها الثانية والستين.

5. It will be recalled that in response to an earlier communication, the World Intellectual Property Organization (WIPO) maintained that the activities of WIPO did not include the question of the protection of the heritage of indigenous peoples, and requested that references to WIPO be deleted from the draft principles and guidelines prepared by the Special Rapporteur.
٥- وجدير بالذكر أن المنظمة العالمية للملكية الفكرية أكدت رداً على رسالة سابقة أن اﻷنشطة التي تضطلع بها المنظمة لا تشمل حماية تراث الشعوب اﻷصلية وطلبت حذف اﻹشارة إلى المنظمة من مشروع المبادئ العامة والتوجيهية الذي أعدته المقررة الخاصة.
