23. With regard to limitation of the scope of the draft articles to the immunities that arise in the context of criminal jurisdiction, the Special Rapporteur would like to point out that this decision was taken by the Commission itself, primarily because it is with respect to this form of jurisdiction that the most serious problems occur in practice.

(4) Paragraph 2 of draft article 1 excludes from the scope of the draft articles certain categories of aliens, namely, aliens enjoying privileges and immunities under international law.

In other words, such aliens are excluded from the scope of the draft articles because of the existence of special rules of international law governing the conditions under which they can be compelled to leave the territory of the State in which they are posted for the exercise of their functions.
وبعبارة أخرى، يستثنى هؤلاء الأجانب من نطاق تطبيق مشاريع المواد بسبب وجود قواعد خاصة من قواعد القانون الدولي تحدد الشروط التي تسمح بإرغامهم على مغادرة إقليم الدولة التي يوجدون فيها لممارسة وظائفهم().

(5) On the other hand, some other categories of aliens who enjoy special protection under international law, such as refugees, stateless persons and migrant workers and their family members, are not excluded from the scope of the draft articles.

(5) On the other hand, some other categories of aliens who enjoy special protection under international law, such as refugees, stateless persons and migrant workers and their family members, are not excluded from the scope of the draft articles.

Moreover, as draft article 2, subparagraph (a), expressly indicates, the exclusion of matters relating to non-admission from the scope of the draft articles does not apply to refugees.

On the basis of the report of the Drafting Committee, the Commission provisionally adopted three draft articles, dealing with the scope of the draft articles (draft article 1) and the normative elements of immunity ratione personae (draft articles 3 and 4), respectively.

It might therefore be wise to exclude regional integration organizations from the scope of application of the draft articles.
