172. The Committee is concerned that Jordanian nationality law prevents a Jordanian woman from passing on her nationality to her children if her husband is not Jordanian.
172 - وتشعر اللجنة بالقلق لأن قانون الجنسية الأردني يحرم المرأة الأردنية من نقل جنسيتها إلى أولادها إذا كان زوجها غير أردني.

The Committee recommends that the State party review and amend the Jordanian Nationality Act (Law No. 7 of 1954) in order to ensure that a Jordanian mother married to a non-Jordanian man has the right to confer her nationality to her children equally and without discrimination.

The Special Rapporteur on violence against women recommended the amendment the Nationality Act to grant Jordanian women the right to confer their citizenship on their children, and remove the reservation to article 9 of the Convention on the Elimination of All Forms of Discrimination against Women with regard to granting equal rights to women with respect to nationality.
8- وأوصت المقررة الخاصة المعنية بمسألة العنف ضد المرأة الأردن بتعديل قانون الجنسية لمنح المرأة الأردنية حق نقل جنسيتها إلى أطفالها، وسحب التحفظ على المادة 9 من اتفاقية القضاء على جميع أشكال التمييز ضد المرأة فيما يتعلق بالمساواة في الحقوق بين المرأة والرجل في موضوع الجنسية(19).

15. Please indicate what the Government is doing to amend or repeal laws whereby a woman cannot transfer her nationality to her children in all cases so as to bring its legislation into conformity with the Convention.
15 - يرجى بيان ما تقوم به الحكومة من جهود لتعديل أو إلغاء القوانين التي تمنع المرأة من نقل جنسيتها إلى أطفالها في جميع الحالات، بحيث يتسنى تطابق هذه التشريعات مع ما تنص عليه الاتفاقية.

4. Ms. Belmihoub-Zerdani said that there were no passages in the Qur'an that could be used to justify prohibiting a woman from transmitting her nationality to her children. Several Muslim countries that had previously maintained reservations to article 9, paragraph 2, of the Convention had now amended their nationality laws and had withdrawn their reservations to that paragraph.
