2. Unless the author of the invalid reservation has expressed a contrary intention or such an intention is otherwise established, it is considered a contracting State or a contracting organization without the benefit of the reservation.

It likewise approved of draft guideline 4.5.2, to the effect that unless a contrary intention had been manifested by the State or international organization that had formulated an invalid reservation, the treaty would be applicable to it without the benefit of the reservation.

39. The first paragraph of guideline 4.5.2 struck the right balance by, on the one hand, introducing the presumption of the continuity of the treaty for the reserving State, and on the other, recognizing that that presumption could be reversed if a contrary intention of the reserving State could be identified.

When an invalid reservation has been formulated in respect of one or more provisions of a treaty, or of certain specific aspects of the treaty as a whole, the treaty applies to the reserving State or to the reserving international organization, not withstanding the reservation, unless a contrary intention of the said State or organization is established.

10. Following the entry into force of the amendment, any State that subsequently becomes a party to the Covenant will be considered to become party to the Covenant as amended, unless such State expresses a different intention.

472.
