6.4 In the absence of any other objections to the admissibility of the communication, and recalling in particular that the Covenant guarantees in articles 18 and 27 freedom of religion exercised in community with others, the Committee considers the remaining claims as pleaded to be sufficiently substantiated, for purposes of admissibility, and proceeds to their consideration on the merits.
6-4 في غياب أي اعتراض آخر على مقبولية البلاغ، وإذ تذكّر اللجنة بالخصوص بأن العهد يضمن في المادتين 18 و27 حرية ممارسة الدين بالاشتراك مع الآخرين، ترى ما تبقى من البلاغ قد دُعم بما فيه الكفاية لأغراض المقبولية وتشرع من ثم في النظر في أسسه الموضوعية.

recalling and reaffirming commitments relating to the human rights and fundamental freedoms of persons with disabilities made at the major United Nations conferences and summits since 1990 and their followup processes and stressing the importance of mainstreaming the disability issue in their implementation,
وإذ تذكّر وتؤكد مجدداً ما تم التعهد به منذ عام 1990 في مؤتمرات الأمم المتحدة وقممها الرئيسية وفي عمليات متابعتها من التزامات تتعلق بحقوق الإنسان والحريات الأساسية للمعوقين، وإذ تشدد على أهمية مراعاة قضايا المعوقين لدى الوفاء بتلك التعهدات،

recalling the resolutions of the Security Council, the General Assembly and the Commission on Human Rights relating to the applicability of the Geneva Convention relative to the Protection of Civilian Persons in Time of War to the occupied Palestinian territory, including East Jerusalem,
وإذ تذكّر بقرارات مجلس الأمن والجمعية العامة ولجنة حقوق الإنسان المتصلة بانطباق اتفاقية جنيف المتعلقة بحماية المدنيين وقت الحرب على الأراضي الفلسطينية المحتلة، بما فيها القدس الشرقية،

recalling the commitment undertaken by States within the framework of the United Nations and other international organizations to work for the promotion of democracy and the rule of law,
وإذ تذكّر بالالتزامات التي قطعتها الدول في إطار الأمم المتحدة وغيرها من المنظمات الدولية بالعمل على النهوض بالديمقراطية وسيادة القانون،

recalling the fact that everyone is entitled to a social and international order in which the rights and freedoms set forth in the Universal Declaration of Human Rights can be fully realized,
وإذ تذكّر بأن لكل فرد حق التمتع بنظام اجتماعي ودولي يمكن أن تتحقق في ظله الحقوق والحريات المنصوص عليها في الإعلان العالمي لحقوق الإنسان تحققاً تاماً،

7.6 On the basis of the information at its disposal, and recalling that article 7 allows no limitation, even in situations of public emergency, the Committee finds that the torture and ill-treatment to which the author was exposed, his incommunicado detention and his conditions of detention, reveal singular and cumulative violations of article 7 of the Covenant.
7-6 وبالاستناد إلى المعلومات التي توفرت لديها، وإذ تذكّر بأن المادة 7 لا تجيز أي تقييد حتى في حالات الطوارئ العامة()، ترى اللجنة أن التعذيب وسوء المعاملة اللذين تعرض لهما صاحب البلاغ وأن احتجازه في سجن انفرادي إلى جانب ظروف احتجازه، عناصر تكشف عن انتهاكات نادرة ومتراكمة للمادة 7 من العهد.
