Mr. Serpa Soares (Portugal) said, with regard to the topic of expulsion of aliens, that the provisions relating to the death penalty and torture or inhuman or degrading treatment in the revised and restructured draft articles on protection of the human rights of persons who had been or were being expelled (A/CN.4/617) required further consideration.

The Mission emphasizes that effective investigation and, if appropriate, prosecution resulting from acts by its agents or by third parties involving deprivation of life, serious injuries and torture or inhuman or degrading treatment or punishment, and other possible violations of international humanitarian law and human rights law, is an obligation of the State of Israel.

Nonetheless, criminal legislation provides for safeguards from multiple violations of human rights that are linked with forced disappearance or are closely related to it, such as illegal deprivation of liberty (art. 143), illegal detention or imprisonment (art. 147) and torture or inhuman or degrading treatment (art. 144).

The complainant claims that her forcible deportation to Ethiopia would amount to a violation by Switzerland of her rights under article 3 of the Convention, since she risks being arrested, interrogated and subjected to torture or other inhumane and degrading treatment by the Ethiopian authorities as a result of her political activities in Switzerland.
3- تدعي صاحبة الشكوى أن ترحيلها قسرياً إلى إثيوبيا يشكل انتهاكاً من جانب سويسرا لحقوقها المنصوص عليها بموجب المادة 3 من الاتفاقية، لأنها قد تتعرض للتوقيف والاستجواب والتعذيب أو غيره من ضروب المعاملة اللاإنسانية والمهينة من جانب السلطات الإثيوبية نتيجة لأنشطتها السياسية في سويسرا.
