2. the remedy of habeas corpus

In either case the remedy is regarded as unexhausted, and the Committee's ruling on communication 701/96 ought to apply to him.
ففي كل من الحالتين، تعتبر وسيلة الانتصاف غير مستنفدة. ولذا فإن قرار اللجنة بشأن البلاغ 701/96 ينبغي أن يطبق عليه.

If the outcome of the criminal proceedings reveals that persons acting in an official capacity were responsible for the shooting and hurting of the author, the remedy should include damages to Mr. Chongwe.

Moreover, on the basis of the information available, the Committee cannot conclude that the fee required prevented the author from exhausting the remedy or that the review would be a priori ineffective.
كما أن اللجنة، استنادا الى المعلومات المتاحة، لا يمكنها أن تستخلص أن الرسوم المطلوبة منعت مقدم البلاغ من استنفاد وسيلة الانتصاف أو أنه كان معروفا سلفا أن نتيجة المراجعة ستكون غير فعالة.

In its Views, the Committee had called for the author to be compensated; the proposal to file for compensation domestically could be interpreted as non-implementation of the remedy recommended and the Committee should decide how to proceed.
وكانت اللجنة قد دعت في آرائها إلى تعويض صاحب البلاغ؛ ويمكن تفسير الاقتراح بالمطالبة بالتعويض محلياً على أنه يعني عدم تنفيذ وسيلة الانتصاف الموصى بها، وينبغي أن تقرر اللجنة كيف ستمضي قدماً بهذا الخصوص.

That the author considers the remedy to be ineffective is immaterial to the issue of exhaustion of domestic remedies and reflects only the personal view of the author's lawyer.
وإن اعتبار مقدمة البلاغ وسيلة الانتصاف هذه غير فعالة هو أمر لا أهمية له بالنسبة لمسألة استنفاد وسائل الانتصاف المحلية ولا يعكس إلا وجهة النظر الشخصية لمحامي مقدمة البلاغ.

Moreover, the existing remedy of costs can be ordered only against a party, not counsel, and even then not until the conclusion of the hearings.

In respect of a complaint based on article 3 of the European Convention on Human Rights concerning a case of expulsion, the European Court of Human Rights said the following about the effective remedy to which article 13 refers:
وفي قرار أصدرته المحكمة الأوروبية لحقوق الإنسان بشأن شكوى تستند إلى المادة 3 من الاتفاقية الأوروبية لحقوق الإنسان بشأن حالة طرد، قالت المحكمة الأوروبية لحقوق الإنسان ما يلي بشأن وسيلة الانتصاف المنصوص عليها في المادة 13:

Instead of seeking to weaken this remedy by dismissing it as an obsolete fiction that has outlived its usefulness, every effort should be made to strengthen the rules that comprise the right of diplomatic protection.
وبدلا من السعي إلى إضعاف وسيلة الانتصاف هذه عن طريق رفضها بوصفها حيلة بالية انقضى أوان منفعتها، ينبغي بذل كل جهد ممكن لتعزيز القواعد التي يتكون منها الحق في الحماية الدبلوماسية.

Since the responsible judge in her case concluded that no crime of rape was committed, this remedy is inapplicable to her situation.
وبما أن القاضي الرئيسي في قضيتها خلص إلى عدم ارتكاب جريمة اغتصاب، فلا تنطبق وسيلة الانتصاف هذه على وضعها.

The State party notes that the author did not allege that this remedy was unreasonably prolonged.
وتلاحظ الدولة الطرف أن مقدمة البلاغ لم تدع أن وسيلة الانتصاف هذه قد طال أمدها دون مبرر.
