An alternative proposal was made along the lines of: " The arbitrators, the appointing authority and the Permanent Court of Arbitration shall not be liable for any act or omission in connection with the arbitration, except for the consequences of conscious or deliberate wrongdoing " .

As you are all aware, the Netherlands has every intention to be a gracious and generous host to the ICC, as it is to so many other legal institutions, most notably so in this context to the International Court of Justice, the Permanent Court of Arbitration and to the International Tribunal for the Former Yugoslavia Foreign Minister Van Aartsen, in his speech in September 2001, made that clear in unambiguous terms.

At a solemn sitting organized in the Great Hall of Justice and attended by the diplomatic corps and representatives of the Dutch authorities, the International Criminal Tribunal for the former Yugoslavia, the IranUnited States Claims Tribunal, the Permanent Court of Arbitration and other international institutions located in The Hague, the President of the Court made a speech, to which the President of the United Mexican States replied.
