111- وفيما يتعلق بالمشروع التجاري الثاني، يخلص الفريق إلى أن صاحب المطالبة لم يقدم أدلة كافية تثبت وجوده في 2 آب/أغسطس 1990، بما أن المستندات المقدمة بخصوص المشروع التجاري جميعها مؤرخة بعد تحرير الكويت.

Having considered all of the evidence, the Panel finds that the Palestinian claimant was the owner of the business as at 2 August 1990 and therefore recommends an award of compensation for the demonstrated losses of the business.

81- وفي ضوء رفض مصرف الإصدار الكويتي الدفع، وهو رفض مبرر على أساس عدم مطابقة المستندات للشروط وعلى أساس أن البضائع كانت قد فقدت فعلاً في تاريخ السداد، يخلص الفريق إلى أن صاحب المطالبة قام بالدفع للمصدِّر على مسؤوليته الشخصية.

Having considered all of the evidence, the Panel finds that the Palestinian claimant has established that he rented the equipped printing press business from the Kuwaiti claimant as at 2 August 1990 and recommends that he be compensated for his demonstrated stock and profit losses only.
