وفي تفريقه بين أفعال التعذيب والأفعال الأخرى القاسية أو المعاملة السيئة فقد نص قانون العقوبات في المادة 161 منه على أن (العقوبة بالحبس مدة لا تتجاوز ثلاث سنوات وبالغرامة التي لا تزيد على عشرة آلاف ريال، أو بإحدى هاتين العقوبتين كل موظف عام استعمل القسوة مع أي شخص أثناء تأدية وظيفته، أو أوجب عليه عملاً في غير الحالات التي يجيز فيها القانون ذلك).

In addition, under article 163 of the Criminal Code it is a crime for a public official to arrest, imprison or detain any person in circumstances other than those provided for by law. Such an act carries a penalty of up to 5 years' imprisonment.

كما نصت المادة ١٩١ على أن: " كل من هتك عرض إنسان باﻹكراه أو بالتهديد أو بالحيلة يعاقب بالحبس مدة لا تجاوز خمس عشر سنة.

١٢١- ونصت المادة ٢٩١ على كل من هتك عرض صبي أو صبية لم يتم كل منهما الحادية والعشرين من عمره، بغير إكراه أو تهديد أو حيله، يعاقب بالحبس مدة لا تجاوز عشر سنوات.

1- من يصنع أو يصور أو يحوز مواد مخلة بالآداب العامة ويتداولها يعاقب بالسجن مدة لا تجاوز شهراً أو بالجلد لا يجاوز أربعين جلدة كما تجوز معاقبته بالغرامة.

26. Anyone who makes, reproduces, promotes or distributes indecent material shall be subject to a penalty of up to one month's imprisonment or 40 lashes of the whip. He may also be fined.
26- من يصنع أو يصور أو يجوز مواد مخلة بالآداب العامة أو يتداولها يُعاقب بالسجن مدة لا تجاوز شهراً أو بالجلد بما لا يجاوز أربعين جلدة كما تجوز معاقبته بالغرامة.

28. Anyone who lures a minor or a person with a mental impairment away from the care of his legal guardian, without the guardian's consent, shall be subject to a penalty of up to seven years' imprisonment and may also be fined.
28- من يستدرج شخصاً غير بالغ أو مختل بأن يأخذه أو يغريه لإبعاده عن حفظ وليه الشرعي دون رضا ذلك الولي يُعاقب بالسجن مدة لا تجاوز سبع سنوات كما تجوز معاقبته بالغرامة.

29. Anyone who presses a person into labour by illegally forcing him to work against his will shall be subject to a penalty of up to one year in prison and/or a fine.
29- من يسخِّر شخصاً بأن يجبره إجباراً غير مشروع على العمل رغم إرادته يُعاقب بالسجن مدة لا تجاوز سنة واحدة أو الغرامة أو العقوبتين معاً.

35. Without prejudice to any higher penalty that may be prescribed in any other law, anyone who violates article 32 shall be subject to a penalty of up to 15 years' imprisonment and a fine to be set by the court.
35- مع عدم الإخلال بأي عقوبة أشد ينص عليها أي قانون آخر يعاقب كل من يخالف أحكام المادة 32 بالسجن مدة لا تجاوز 15 سنة وبالغرامة التي تحددها المحكمة.
