(2) a supplier or contractor may appeal any decision taken in challenge proceedings under article 65 or 66 of this Law.
(2) يجوز لأيِّ مورِّد أو مقاول أن يستأنف أيَّ قرار متّخذ بشأن إجراءات الاعتراض بمقتضى المادة 65 أو 66 من هذا القانون.

(1) a supplier or contractor may request a clarification of the solicitation documents from the procuring entity.
)١( يجوز للمورد أو المقاول أن يطلب من الجهة المشترية ايضاحا بشأن وثائق التماس العطاءات.

No negotiations shall take place between the procuring entity and a supplier or contractor with respect to a quotation submitted by the supplier or contractor.
ولا تجرى أي مفاوضات بين الجهة المشترية وأي مورد أو مقاول بشأن عرض أسعار مقدم من المورد أو المقاول.

The procuring entity shall respond to any request by a supplier or contractor for clarification of the solicitation documents that is received by the procuring entity within a reasonable time prior to the deadline for the submission of tenders.
وعلى الجهة المشترية أن ترد على أي طلب يقدمه مورد أو مقاول من أجل استيضاح وثائق التماس العطاءات وتتلقاه الجهة المشترية في غضون فترة معقولة قبل الموعد النهائي لتقديم العطاءات.

a supplier or contractor whose tender security is not extended, or that has not provided a new tender security, is considered to have refused the request to extend the period of effectiveness of its tender.
وأي مورد أو مقاول لم تمدد صلاحية ضمان عطائه، أو لم يقدم ضمان عطاء جديدا يعتبر أنه قد رفض طلب تمديد فترة سريان مفعول عطائه.

(b) A procuring entity may disqualify a supplier or contractor if it finds at any time that the information submitted concerning the qualifications of the supplier or contractor was materially inaccurate or materially incomplete;
)ب( ويجوز للجهة المشترية أن تقرر عدم أهلية مورد أو مقاول إذا اكتشفت في أي وقت أن المعلومات المقدمة بخصوص مؤهلات المورد أو المقاول مشوبة بعدم الدقة أو النقص من جوانب أساسية؛

(1) (a) The procuring entity may ask a supplier or contractor for clarifications of its tender in order to assist in the examination and evaluation of tenders;
(1) (أ) يجوز للجهة المشترية أن تطلب من المورّد أو المقاول إيضاحات بشأن عطائه لكي تساعدها على فحص العطاءات وتقييمها؛

In his view, a supplier or contractor submitting " materially incorrect or materially incomplete " information concerning qualifications should be disqualified.
ففي رأيه، ينبغي إسقاط أهلية المورّد أو المقاول الذي يقدم " معلومات تنطوي على خطأ جوهري أو نقص جوهري " .

Any requirements, guidelines, documents, clarifications or other information relative to the negotiations that are communicated by the procuring entity to a supplier or contractor [but which are not specific or exclusive to that supplier or contractor] shall be communicated on an equal basis to all other suppliers or contractors engaging in negotiations with the procuring entity relative to the procurement. "
وكل متطلبات أو مبادئ توجيهية أو وثائق أو توضيحات أو معلومات أخرى ذات صلة بالمفاوضات تبلّغها الجهة المشترية إلى مورّد أو مقاول [، لكنها لا تخصّ ذلك المورّد أو المقاول أو تكون قاصرة عليه،] تبلّغ على قدم المساواة إلى سائر المورّدين أو المقاولين المتفاوضين مع الجهة المشترية فيما يتعلق بالاشتراء. "

a supplier or contractor not wishing to submit a final tender may withdraw from the tendering proceedings without forfeiting any tender security that the supplier or contractor may have been required to provide.
ويجوز للمورد أو المقاول الذي لا يرغب في تقديم عطاء نهائي أن ينسحب من إجراءات المناقصة دون سقوط حقه في أي ضمان للعطاء كان قد اشترط على المورد أو المقاول تقديمه.

[3. a supplier or contractor may appeal any decision taken in challenge proceedings under article 66 or 67 of this Law in the [name of the court or courts]].
[3- يجوز لأيِّ مورِّد أو مقاول أن يستأنف أيَّ قرار متّخذ بشأن إجراءات الاعتراض بمقتضى المادة 66 أو المادة 67 من هذا القانون لدى [يُدرَجُ هنا اسم المحكمة أو أسماء المحاكم]].

(a) When a State, whether a supplier or recipient, does not exercise restraint in the production, transfer and acquisition of such weapons beyond those needed for legitimate national and collective defence and internal security;
)أ( عندما لاتمارس الدول، الموردة أو المتلقية لﻷسلحة على حد سواء، ضبط النفس في انتاج ونقل وإقتناء هذه اﻷسلحة، بحيث تتجاوز الحدود اللازمة للاحتياجات المشروعة للدفاع الوطني والجماعي واﻷمن الداخلي؛

(1) a supplier or contractor that claims to have suffered or claims that it may suffer, loss or injury due to alleged non-compliance with the provisions of this Law may seek a reconsideration or review of the alleged non-compliance, in accordance with articles [62 to 66] of this Law or with other provisions of applicable law of this State.
(1) يجوز لأي مورِّد أو مقاول يدّعي أنه تعرّض، أو أنه قد يتعرّض، لخسارة أو ضرر بسبب عدم امتثال مزعوم لأحكام هذا القانون أن يلتمس مراجعة عدم الامتثال المزعوم أو إعادة النظر فيه، وفقاً للمواد [62 إلى 66] من هذا القانون أو لأحكام أخرى من القانون المنطبق في هذه الدولة.

(1) a supplier or contractor may request a clarification of the solicitation documents from the procuring entity.

3. In States in which solicitation documents are issued in more than one language, it would be advisable to include in the procurement law, or in the procurement regulations, a rule to the effect that a supplier or contractor should be able to base its rights and obligations on either language version.
3- وفي الدول التي تصدر فيها وثائق الالتماس بأكثر من لغة، يُنصح بأن تُدرج في قانون الاشتراء، أو في لوائح الاشتراء التنظيمية، قاعدة مؤدّاها أنَّه ينبغي أن يكون المورِّد أو المقاول قادرا على أن يبني حقوقه والتزاماته على أساس أيٍّ من هاتين اللغتين أو من هذه اللغات.

No negotiations shall take place between the procuring entity and a supplier or contractor with respect to a quotation submitted by the supplier or contractor.
ولا تجرى أي مفاوضات بين الجهة المشترية ومورد أو مقاول بشأن عرض أسعار مقدم من المورد أو المقاول.

a supplier or contractor whose tender security is not extended, or that has not provided a new tender security, is considered to have refused the request to extend the period of effectiveness of its tender.
ويُعتبر المورِّد أو المقاول الذي لم تُمدَّد ضمانة عطائه، أو الذي لم يقدّم ضمانة عطاء جديدة، أنه قد رَفَض طلب تمديد فترة نفاذ مفعول عطائه.

a supplier or contractor that fails to participate in the review proceedings is barred from subsequently making the same type of claim.
ويمتنع على المورد أو المقاول الذي يتخلف عن المشاركة في إجراءات إعادة النظر أن يقوم لاحقا بتقديم مطالبة من نفس النوع.
