82. With regard to the communication from Costa Rica dated 15 July 2013, he noted that it invoked paragraph 5 (a) of annex I to the rules of procedure of the Commission, but that Costa Rica had never claimed continental shelf beyond 200 nautical miles from its coast in the Caribbean Sea, and that its reliance on paragraph 5 (a) of annex I to the rules of procedure was not justified.

In reference to paragraph 2 (a) of annex I to the rules of procedure, Mr. Muigai indicated that Kenya had entered into a maritime boundary agreement with the United Republic of Tanzania on 23 June 2009, which applied to the territorial sea, exclusive economic zone and continental shelf, including the continental shelf beyond 200 nautical miles upon the finalization of its delineation.
