According to Section 2 of the Prisons Act, a prisoner means any person, whether convicted or not, under detention in any prison.

Any person detained in custody may be so detained in any prison, police station or immigration depot, or in any other place appointed for the purpose by the Director-General.

(b) civil and criminal prisoners, and no civil prisoner shall be detained in the same part of any prison as any criminal prisoner;
)ب( السجناء المدنيون والسجناء الجنائيون، ولا يُعتقل أي سجين بموجب القانون المدني في نفس الجناح في أي سجن مع أي سجين بموجب القانون الجنائي؛

(d) prisoners sentenced to preventive detention under Section 54 of the Criminal Justice (Administration Act) and as far as possible no prisoner sentenced to preventive detention shall be detained in the same part of any prison as any other prisoner;
)د( السجناء المحكوم عليهم بالحبس الاحتياطي بموجب المادة ٤٥ من )قانون ادارة( القضاء الجنائي، ولا يحبس بقدر الامكان أي سجين محكوم عليه بالحبس الاحتياطي في نفس الجناح في أي سجن مع أي سجين آخر؛

It is not permissible for the governor of any prison to admit a person other than under the terms of an order signed by the competent authority nor may he detain a person after the term specified in the order has elapsed (art. 41, CCP).
ولا يجوز لمأمور أي سجن قبول أي إنسان فيه إلا بمقتضى أمر موقع عليه من السلطة المختصة وألا يبقيه بعد المدة المحددة بهذا الأمر (المادة 41 إجراءات جنائية).

(7) Any person detained under the powers conferred by this section shall be deemed to be in lawful custody, and may be detained in any prison, or in any police station, or in any other similar place authorized generally or specially by the Minister. "
(7) أي شخص يحتجز بموجب السلطات الممنوحة في هذه المادة يعتبر محتجزاً قانونياً ويجوز احتجازه في أي سجن أو في أي مركز شرطة أو في أي مكان مشابه يصرح به الوزير بصورة عامة أو خاصة. "

Subsection 6(4) further provides that any banished person in the custody of a senior police officer may be received into and detained in any prison or other suitable place in Malaysia until he is placed for conveyance in accordance with subsection 6(3).
وتنص المادة الفرعية 6 (4) كذلك على أنه يجوز استقبال واحتجاز أي شخص ممنوع من الإقامة في عهدة ضابط شرطة أقدم في أي سجن أو مكان آخر مناسب في ماليزيا إلى أن يتسنى نقله وفقا للمادة الفرعية 6 (3).

In addition, any person reasonably believed to be a person liable to removal from Singapore under the Immigration Act may be arrested and detained in any prison, police station or immigration depot for no more than 14 days pending a decision as to whether an order for his or her removal should be made (section 35).
