The UNCITRAL Model Law envisages a " foreign (representative) " as including one appointed on an " interim basis " , but not one whose appointment has not yet commenced -- for example, by virtue of a stay of an order appointing the insolvency (representative) pending an appeal. Where there is a change in the status of the foreign (representative) subsequent to their appointment, that issue would be addressed under article 18, subparagraph (a).
35- ويعتبر قانون الأونسيترال النموذجي أنَّ " الممثّل الأجنبي " يشمل الممثِّل الذي عُيّن " على أساس مؤقت " وليس الذي لم تبدأ إجراءات تعيينه بعدُ؛ وذلك على سبيل المثال بسبب وقف أمر تعيين ممثّل إعسار في انتظار الاستئناف.() وفي الحالات التي يحصل فيها تغيير في وضع الممثل الأجنبي بعد تعيينه، تصبح المسألة خاضعة للفقرة الفرعية (أ) من المادة 18.

29.
