In this respect, the Committee recommends that the State party ensure that its domestic legislation and practice prohibit in any case the trade of small arms and light weapons to countries where persons who have not attained the age of 18 may take a direct part in hostilities as members of their armed forces or armed groups that are distinct from the armed forces of a State.

The Committee recommends that the State party ensure that its domestic laws, guidelines and practice on exports of arms and other military equipment explicitly prohibit the direct and indirect export of arms and military equipment to countries where persons who have not attained the age of 18 may take a direct part in hostilities as members of their armed forces, or armed groups that are distinct from the armed forces of a State.

Furthermore, the acts of the armed forces of a State must be carried out in accordance with the Charter of the United Nations and international humanitarian law.

the invasion or attack by the armed forces of a State of the territory of another State, or any military occupation, however temporary, resulting from such invasion or attack, or any annexation by the use of force of the territory of another State or part thereof;

In that regard, it was noted that the definition of terrorism in draft article 2 should include activities of individuals in command of the armed forces of a State or in control of armed groups in situations where these activities are not governed by international humanitarian law.

78. Accordingly, her Government believed that the issue of jurisdictional immunity of foreign armed forces should, in accordance with past practice, be dealt with bilaterally between the sending State and the host State, and that armed forces of a State stationed in another State should be uniformly excluded from the scope of the draft articles.

Insofar as it is relevant and having regard to common article 2, paragraph 2, of the Geneva Conventions of 1949, international humanitarian law applies even in a situation, where for example the armed forces of a State party temporarily occupy the territory of another State, without meeting any resistance from the latter.
