والحقيقة أنه إذا كانت الدولة لا يفترض فيها جهلها بالمنع الناجم عن بند تحفظ، فإنه يتعين عليها كذلك أن تدرك أنه لا يجوز لها أن تفرغ معاهدة من محتواها بتحفظ يتنافى مع موضوع المعاهدة والغرض منها.
