In addition, the State party should ensure that where there is reasonable ground to believe that an act of torture has been committed, impartial and effective investigations should be launched immediately, even in cases where a commanding officer considers that the allegation is not well-founded.

3.7 The complainant also maintains that article 12 of the Convention, under which the competent authorities are to proceed to a prompt and impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed, has been violated by the State party in his case.
3-7 ويدعي صاحب الشكوى أيضاً حدوث انتهاك للمادة 12 من الاتفاقية، التي تتطلب إجراء تحقيق فوري ونزيه كلما وجدت أسباب معقولة تدعو إلى الاعتقاد بأن فعلاً من أفعال التعذيب قد ارتكب، من قبل الدولة الطرف في هذه الحالة().

The Committee also recalls that, during its dialogue with the State party in 2008, it had expressed its concern regarding the case of Mounir Hammouche and had reminded the State party of its obligation to launch a prompt and impartial investigation immediately and systematically in all cases where there are reasonable grounds to believe that an act of torture has been committed, including cases in which a prisoner has died.

10.4 The Committee notes that article 12 of the Convention places an obligation on the authorities to proceed automatically to a prompt and impartial investigation whenever there is reasonable ground to believe that an act of torture or ill-treatment has been committed, no special importance being attached to the grounds for the suspicion.o
10-4 وتلاحظ اللجنة أن السلطات ملزمة، وفقاً لأحكام المادة 12 من الاتفاقية، بأن تشرع فوراً في إجراء تحقيق نزيه كلما كانت هناك أسباب معقولة تبعث على الاعتقاد بحصول تعذيب أو سوء معاملة، دون أن يكون لسبب الشبهة أهمية خاصة(س).
