153. On 16 October 1996 two men, Mr. Avni Nura and Mr. Besim Ramaj, were reportedly arrested by the police on the road between Lubovec and Galice.

57. In court the main defendant, Besim Rama, stated on 3 June 1997 that from the moment that he was arrested, until the time that he was brought before the investigative judge, the police did not stop beating him.

٨٥- واعترف بسيم راما في المحكمة، في بادئ اﻷمر، باشتراكه في أحد اﻷحداث، وهو إطلاق النار على سيارة للشرطة في حزيران/يونيه ٦٩٩١ قُتل فيها شرطي.

However, when the trial resumed on 9 July, Besim Rama retracted his statement acknowledging his involvement in the June 1996 shooting, claiming that he had made that statement out of fear of the police.
بيد أنه عند استئناف المحاكمة في ٩ تموز/يوليه، تراجع بسيم راما عن أقواله التي اعترف فيها بتورطه في حادث إطلاق النار الذي وقع في حزيران/يونيه ٦٩٩١، مدعياً أنه قد قال ذلك خوفاً من الشرطة.

The court, however, is not known to have investigated this or other allegations by Besim Rama that his statement had been obtained through torture or duress, as required by the Convention against Torture.

وقد أخبر اثنان من المدعى عليهم، هما بسيم راما وأفني نورا، المحكمة بأنهما قد احتُجزا احتجازاً غير معترف به في مكان غير معلوم في الفترة ما بين ٦١/٧١ أيلول/سبتمبر و٢ تشرين اﻷول/أكتوبر ٦٩٩١، دون أن تتاح لهم فرصة الاتصال بأحد.

65. As in the previous case, the main evidence produced by the prosecution was the stated confessions of the accused before the investigative judge, and the admission made in court by the main accused, Besim Rama, which he subsequently retracted.
٥٦- وعلى غرار ما حدث في القضية السابقة، كانت اﻷدلة الرئيسية التي قدمها الادعاء هي الاعترافات التي أدلى بها المتهمون أمام قاضي التحقيق، والاعترافات التي أدلى بها المتهم الرئيسي بسيم راما في المحكمة والتي تراجع عنها بعد ذلك.
