The Meeting called on Member States and relevant United Nations agencies to collect relevant information concerning children alleged to have, or accused of or recognized as having, infringed the penal law, in particular children deprived of their liberty, so as to improve the administration of juvenile justice.

To address these high rates of incarceration, the Committee draws the attention of States parties to article 40, paragraph 3 (b), of the Convention requiring States to undertake measures to deal with children alleged as, accused of, or recognized as having infringed the penal law without resorting to judicial proceedings, whenever appropriate.

Article 40 (3) of the Convention on the Rights of the Child requires States to undertake measures to deal with children alleged as, accused of or recognized as having infringed penal law without resorting to judicial proceedings, whenever appropriate.

The Committee considers also that a footnote referring to key United Nations standards in this domain would help to ensure that the draft outcome document reflects appropriately the obligation to ensure respect for the human rights of children alleged or recognized as having infringed the law.
