The Eritrean laws prohibit the use of torture, inhuman or degrading treatment of punishment against any person, including children who are detained.
ويحظر القانون الإريتري اللجوء إلى التعذيب وغيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة في حق أي شخص، بما يشمل الأطفال المحتجزين.

While all migrants can be detained in inappropriate facilities, such as prisons which house convicted criminals, children who are detained in immigration detention in addition rarely have access to adequate education, play and leisure facilities, and staff who are trained to respond to the specific needs of migrant children.

“Where at any time there is a lack of suitable accommodation or adequate facilities for a particular individual in any institution in which young offenders are detained, or where the mixing of adults and children is deemed to be mutually beneficial, the United Kingdom reserves the right not to apply article 37 (c) insofar as those provisions require children who are detained to be accommodated separately from adults”.* [3 August 1999]
وحيثما لا يتوفر في أي وقت مكان إقامة مناسب أو مرافق مناسبة لشخص معين في أية مؤسسة يحتجز فيها الجانحون من الشبان، أو حيثما يرتأى أن الجمع بين البالغين والأطفال فيها يفيد كلا منهم، تحتفظ المملكة المتحدة بالحق في عدم تطبيق المادة 37(ج) طالما أن هذه الأحكام تطالب بإقامة الأطفال المحتجزين في مكان منفصل عن الكبار " *.

Where at any time there is a lack of suitable detention facilities or where the mixing of adults and children is deemed to be mutually beneficial, the United Kingdom, in respect of each of its dependent territories, reserves the right not to apply article 37 (c) insofar as those provisions require children who are detained to be accommodated separately from adults.
