212. According to one representative, by the definition contained in article 2 (b) that a watercourse was a system of surface waters and groundwaters constituting a unitary whole and flowing into a common terminus, confined groundwater would thus be excluded from the draft articles.
٢١٢ - وذهب ممثل الى أن التعريف الوارد للمجرى المائي في المادة ٢ )ب( بأنه شبكة مياه سطحية وجوفية تشكل كلا واحدا وتتدفق صوب نقطة وصول مشتركة من مؤداه أن تُستبعد بالتالي المياه الجوفية المحصورة من نطاق تطبيق مشروع المواد.

23. The idea of including unrelated confined groundwater intrigued his delegation. It looked forward to the Commission's decision on the matter and for the moment noted that most hydrologists would support a unified approach that would treat confined underground waters in the same way as an above-ground lake.
٢٣ - وقال إن فكرة إدراج المياه الجوفية المحصورة غير المتصلة بأية مجاري مائية تثير قلق وفده الذي ينتظر باهتمام قرار لجنة القانون الدولي بشأن هذه المسألة ويلاحظ اﻵن أن غالبية الخبراء في مسائل المياه يؤيدون نهجا موحدا يتمثل في معالجة المياه الجوفية المحصورة بنفس الطريقة التي تعالج بها البحيرات.

As a whole, the draft articles represented a balanced system of regulations that would justify the convening of an international conference at which it should be possible to find acceptable solutions to outstanding or controversial questions and, if applicable, to consider the issue of confined groundwater.
٥١ - وخلص الى القول إن مشاريع المواد، في مجملها، تشكل مجموعة متوازنة من القواعد من شأنها أن تبرر الدعوة إلى عقد مؤتمر دولي يتعين خلاله ايجاد حلول مقبولة للمسائل المعلقة أو المختلف بشأنها والقيام في نهاية المطاف بدراسة مسألة المياه الجوفية المحصورة.

Turning to the draft articles on the law of the non-navigational uses of international watercourses, he noted that the adoption of the final draft of the articles and of a resolution on confined groundwater had brought closer the conclusion of a framework convention on the entire subject.
٨٩ - وانتقل الى مشاريع المواد المتعلقة بقانون استخدام المجاري المائية الدولية في اﻷغراض غير الملاحية، فلاحظ أن اعتماد المشروع النهائي للمواد وقرار بشأن المياه الجوفية المحصورة قد ساعد على تقريب موعد إبرام اتفاقية إطارية بشأن الموضوع برمته.

The remark was also made that any hasty attempt to include " unrelated confined groundwater " within the topic, at a time when the general acceptability of the draft articles was still in doubt, would only further complicate the issue and give rise to more controversy.
وأبديت ملاحظة أيضا مؤداها أن أي محاولة متسرعة ﻹدراج " المياه الجوفية المحصورة غير المتصلة " في الموضوع في وقت ما زال التقبل العام لمشروع المواد أمرا غير متيقن منه، لن يؤدي إلا لزيادة تعقيد الموضوع ويثير مزيدا من الجدل.

In his delegation's view, the term " groundwater " should encompass only confined groundwater resources, and the vulnerability and renewability of such resources, as well as their significance for the freshwater supply, should be taken into account in elaborating a regime to govern them.
