The 1963 Vienna Convention on Consular Relations (art. 36) provides that, if so requested, the competent authorities of the receiving State shall, without delay, inform the consular post of the sending State that its national has been deprived of his/her liberty.

65. The Vienna Convention on Consular Relations, adopted on 24 April 1963, is somewhat different from the instruments analysed above in terms of both the categories of persons who are members of a " consular post " and the scope of their immunity from jurisdiction.

Article 36, paragraph 1 (b), of the Vienna Convention on Consular Relations states that, if requested, the competent authorities of the receiving State shall, without delay, inform the consular post of the sending State if, within its consular district, a national of that State is detained.

On the basis of that interpretation, the Court held that in 51 of the cases the United States had breached its obligation to inform a foreign national of his rights to consular notification when " arrested or committed to prison or to custody pending trial or ... detained in any other manner " , and in 49 of the cases the United States had failed to notify a Mexican consular post about the detention of Mexican nationals.
