196. MSC at its 73rd session approved the IMO draft Code of Practice for the Investigation of the Crimes of Piracy and Armed Robbery Against Ships.52 The Code will be considered for adoption by the IMO Assembly at its 22nd session to be held from 19 to 30 November 2001.

In the process of investigating a crime of piracy at sea States parties shall be guided by the Code of Practice for the Investigation of the Crimes of Piracy and Armed Robbery against Ships, adopted by the International Maritime Organization.

It has been proposed that the legislation should be supplemented with legal provisions that would expand specific procedural powers of commanders of military vessels and captains of non-military vessels, endowing them with investigative authority; increase the number of participants in criminal cases to include individuals providing legal assistance to suspected pirates; and modify procedural deadlines for the investigation of Crimes of Piracy.
وقد اقتُرِح أن تستكمل التشريعات بأحكام قانونية لتوسيع بعض الصلاحيات الإجرائية المحددة الخاصة بقادة السفن العسكرية وقباطنة السفن غير العسكرية، بتخويلهم سلطة التحقيق؛ وزيادة عدد المشاركين في القضايا الجنائية بحيث يشملون الأفراد الذين يقدمون المساعدة القانونية للقراصنة المشتبه بهم؛ وتعديل المواعيد النهائية للاضطلاع بإجراءات التحقيق في جرائم القرصنة.

Mr. Mitropoulos explained that other IMO activities regarding the combating of piracy and armed robbery included the preparation of a draft Code of Practice for the Investigation of the Crimes of Piracy and Armed Robbery against Ships for submission to the IMO Assembly at its twenty-second session in November 2001.

We welcome the Code of Practice for the Investigation of the Crimes of Piracy and Armed Robbery against Ships adopted by twenty-second Assembly of the International Maritime Organization (IMO). We also support the IMO's efforts to promote regional cooperation to address this problem, and we have participated in many meetings and seminars organized by the IMO to enhance implementation of its guidelines on preventing such attacks.

It has also adopted a series of other guidance documents on how to prevent, prepare for, and react to incidents of piracy and armed robbery at sea, including the Code of Practice for the Investigation of the Crimes of Piracy and Armed Robbery against Ships.
