1. Article 49 specifies the conditions under which the buyer is entitled to declare the contract avoided.

As further justification, the court affirmed that the defendant could declare the contract avoided only if there was a fundamental breach of contract within the meaning of article 25 CISG.
وكمسوّغ آخر، أكدت المحكمة أنه لا يجوز للشركة المدعى عليها إعلان بطلان العقد إلا عند وجود مخالفة جوهرية للعقد بالمعنى المقصود في المادة 25 من اتفاقية البيع.

Provided the breach is of sufficient gravity it can also amount to a fundamental breach and allow the buyer to declare the contract avoided.
