The Committee also encourages the State party to step up its efforts, by developing strategies for dissemination, awareness-raising and dialogue with local authorities, to ensure that all the states issue laws prohibiting discrimination based on disability and recognize the denial of reasonable accommodation as a form of discrimination.

65. The Committee is gravely concerned at the fact that there is no legislation to protect persons with disabilities from discrimination, including denial of reasonable accommodation, in the labour sector.

The Committee also urges the State party to incorporate the concept of reasonable accommodation into its new draft law on the rights of persons with disabilities and to ensure that this piece of legislation and all other relevant laws clearly affirm the denial of reasonable accommodation as a form of discrimination on the grounds of disability.

12. The Committee urges the State party to take the legislative and administrative measures necessary to prohibit discrimination on the basis of disability, and to explicitly include denial of reasonable accommodation as a form of discrimination on the basis of disability.

The amendment to the Act also involved the addition of article 9, section XXII ter, which includes under discrimination the denial of reasonable accommodation that guarantee the enjoyment or exercise on equal terms of the rights of the persons with disabilities.
كما استلزم إصلاح القانون الاتحادي لمنع التمييز والقضاء عليه إضافة الجزء الثاني والعشرين مكرراً ثانياً من المادة 9، الذي يعتبر الحرمان من الترتيبات التيسيرية المعقولة التي تكفل تمتع الأشخاص ذوي الإعاقة بحقوقهم أو ممارستهم لها، على قدم المساواة مع غيرهم، شكلاً من أشكال التمييز.

44. The Committee reiterates that denial of reasonable accommodation constitutes discrimination and that the duty to provide reasonable accommodation is immediately applicable and not subject to progressive realization. It recommends that the State party:

The Committee urges the Governments of Denmark, the Faroe Islands and Greenland to adopt new comprehensive cross-sectoral anti-discrimination legislation that extends protection to beyond the labour market and affirms the denial of reasonable accommodation as a form of discrimination on the basis of disability.
١٥- تحث اللجنة حكومات الدانمرك وجزر فارو وغرينلند على اعتماد تشريعات جديدة شاملة ومتعددة القطاعات مناهضةً للتمييز توسع نطاق الحماية لتشمل قطاعات أخرى غير قطاع سوق العمل وتؤكد أن عدم توفير ترتيبات تيسيرية معقولة ضربٌ من ضروب التمييز على أساس الإعاقة.

5. Please indicate whether denial of reasonable accommodation is considered a form of discrimination in the State party.

28. In its general comment No. 5, the Committee defined discrimination against persons with disabilities as " any distinction, exclusion, restriction or preference, or denial of reasonable accommodation based on disability which has the effect of nullifying or impairing the recognition, enjoyment or exercise of economic, social or cultural rights " .
28- عرّفت اللجنة، في تعليقها العام رقم 5، التمييز ضد الأشخاص ذوي الإعاقة() بأنه أي تمييز أو إقصاء أو تقييد أو تفضيل أو حرمان من ترتيبات تيسيرية معقولة بسبب الإعاقة مما يؤدي إلى إبطال أو تعطيل الاعتراف بالحقوق الاقتصادية والاجتماعية والثقافية أو التمتع بها أو ممارستها. " ().

26. Mr. Bródi (Hungary), Vice-President of the Conference, said that one of the most important innovations of the Convention was that it included the denial of reasonable accommodation as a form of discrimination.
26 - السيد برودي (هنغاريا)، نائب رئيس المؤتمر: قال إن من أهم ابتكارات الاتفاقية تضمنها الحرمان من توفير أماكن إقامة معقولة بوصفه شكلا من أشكال التمييز.

The denial of reasonable accommodation should be included in national legislation as a prohibited form of discrimination on the basis of disability.

It further recommends that the State party ensure that the denial of reasonable accommodation is regarded as a form of discrimination under the law and as a matter of policy.
