The law may provide for deprivation of liberty only in the following cases:
ولا يجوز أن يفرض القانون الحرمان من الحرية إلا في الحالات التالية:

Particular attention should be paid to considering deprivation of liberty only as a measure of last resort and for the shortest possible period of time, to the protection of the rights of children deprived of their liberty, to due process of law and to the full independence and impartiality of the judiciary.
ولا بد من الاهتمام بوجه خاص بعدم اللجوء الى الحرمان من الحرية إلا كحل أخير وﻷقصر فترة زمنية ممكنة، وبحماية حقوق اﻷطفال المحرومين من حريتهم في المحاكمة العادلة، واستقلال ونزاهة القضاء.

132. The Committee strongly urges the State party to use the deprivation of liberty only as a measure of “last resort” in dispensing juvenile justice, as required by the Convention.

However, it is also clear that many States parties still have a long way to go in achieving full compliance with CRC, e.g. in the areas of procedural rights, the development and implementation of measures for dealing with children in conflict with the law without resorting to judicial proceedings, and the use of deprivation of liberty only as a measure of last resort.

An effective package of alternatives must be available (see chapter IV, section B, above), for the States parties to realize their obligation under article 37 (b) of CRC to use deprivation of liberty only as a measure of last resort.

63. The Working Group takes the view that this principle not only means that nobody shall be deprived of his or her liberty in violation of the law or as a result of the exercise of a fundamental right, but that it first of all requires that States should have recourse to deprivation of liberty only insofar as it is necessary to meet a pressing societal need, and in a manner proportionate to that need.
