The detainees' right to health is stipulated in the following provisions of act No. 473:
135- ويرد حق المحتجزين في الصحة في الأحكام التالية من القرار رقم 473:

Moreover, the restrictions on detainees' right to be present at hearings in their case and on their access to the information and evidence on which the allegation that they are unlawful belligerents is based undermine the legality and legitimacy of the process;

(c) Maintain video recordings of all interrogations and install video surveillance in all areas of custody facilities where detainees may be present, except in cases where detainees' right to privacy or to confidential communication with their lawyer or a doctor may be violated.

The Optional Protocol will thus provide a further mechanism for ensuring that the human rights of all (including, for example, detainees' right to food) are respected, protected and fulfilled.

For instance, in June 2012, the Committee against Torture expressed its serious reservations as to whether Cuba respected due process guarantees, such as the detainees' right to have adequate time and facilities to prepare their defence and to communicate with counsel of their choosing, in the last three executions that were carried out after a summary procedure in 2003.
فعلى سبيل المثال، أبدت لجنة مناهضة التعذيب في حزيران/يونيه 2012 تحفظاتها الشديدة إزاء ما إذا كانت كوبا قد احترمت الضمانات القانونية الواجبة مثل حق المحتجزين في الحصول على ما يكفي من الوقت والتيسيرات لإعداد دفاعهم والتواصل مع محامي من اختيارهم، في حالات الإعدام الثلاث الأخيرة التي نفذت بعد إجراءات موجزة في عام 2003.

Para. 11: Guarantees of detainees' right to be treated humanely and with respect for their dignity; relieving overcrowding; providing hygienic facilities, and assuring access to health care and adequate food; identifying alternative sanctions (art. 10).

The Government considered that that system was balanced, since it guaranteed that investigations were conducted properly without infringing detainees' right to due process; its view was based on Spanish case law, which held that statements made by an accused to police authorities lacked incriminatory value if such statements were not confirmed during subsequent proceedings on the advice of legal counsel chosen freely by the accused.
وترى الحكومة أن هذا النظام متوازن، إذ إنه يكفل سير التحقيقات على النحو الصحيح دون الإخلال بحق المحتجزين في المحاكمة وفق الأصول القانونية؛ وتستند آرائها إلى قانون السوابق القضائية الإسباني الذي يقضي بأن الأقوال التي يدلي بها أي متهم لسلطات الشرطة يفتقر إلى القيمة التجريمية إذا لم تؤكد الأقوال أثناء الإجراءات اللاحقة بناءً على نصيحة المستشار القانوني الذي يقوم المتهم باختياره بحرية.
