7.7 On the basis of the above, the Committee considers that the information made available by the complainant does not show that substantial grounds exist for believing that he would be personally in danger of being subjected to torture in the event of his return to the Sudan.
7-7 وبناء علـى ما تقـدم، ترى اللجنة أن المعلومـات التي عرضهـا عليها صاحب الشكوى لا تبين أن ثمة أسباباً جوهرية تدعو إلى الاعتقاد بأنه سيكون شخصياً في خطـر التعـرض للتعذيـب في حالة إعادته إلى السودان.

The issue before the Committee is whether the forced return of the author to Pakistan would violate the obligation of Canada under article 3 of the Convention not to expel or to return a person to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture.
فالمسألة المعروضة على اللجنة هي ما إذا كان في اﻹعادة القسرية لمقدم البلاغ إلى باكستان انتهاك لالتزامات كندا بموجب المادة ٣ من الاتفاقية بعدم طرد شخص أو إعادته إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه سيكون في خطر التعرض للتعذيب.

51. Article 3, paragraph 1, of the Convention against Torture provides that " no State Party shall expel, return (`refouler') or extradite a person to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture " .
٥١- نصت الفقر ١ من المادة الثالثة من اتفاقية مناهضة التعذيب على أنه لا يجوز لأية دولة طرف أن تطرد أي شخص أو أن تعيده أو أن تسلمه إلى دولة أخرى، إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه سيكون في خطر التعرض للتعذيب.

3. A.K. claims that his forced repatriation to Sudan would violate his rights under article 3 of the Convention, as there are substantial grounds for believing that he would be in danger of being subjected to torture.
3- يدعي ع.خ أن إعادته القسرية إلى السودان تمثل انتهاكا لحقوقه بموجب المادة 3 من الاتفاقية، نظرا لتوافر أسباب حقيقية تدعو إلى الاعتقاد بأنه سيكون في خطر التعرض للتعذيب.

In his circumstances, a medical examination was necessary, in particular, in the light of the State party's obligation under article 3, paragraph 2, of the Convention, to take into account all relevant considerations to determine whether there are substantial grounds for believing that he would be in danger of being subjected to torture in the country of origin.

7.7 The last issue before the Committee is whether the forced removal of the complainant to Iraq violated the State party's obligation under article 3 of the Convention not to expel or return a person to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture.
7-7 المسألة الأخيرة المعروضة أمام اللجنة هي ما إذا كان النقل القسري لصاحب الشكوى إلى العراق ينتهك التزام الدولة الطرف بموجب المادة 3 من الاتفاقية التي تنص على أنه لا يجوز طرد أي شخص أو إعادته إلى دولة أخرى، إذا توافرت أسباب حقيقية تدعو إلى الاعتقاد بأنه سيكون في خطر التعرض للتعذيب.

The complainant maintains that there are substantial grounds for believing that he would be subjected to torture if he were returned to the Libyan Arab Jamahiriya and that, consequently, his expulsion to that country would constitute a violation by Switzerland of article 3 of the Convention.
