It must be noted that this lack of knowledge of the law certainly leads to situations of excessive and arbitrary detention periods which are said to be conducive to torture and other forms of illtreatment.
كما يجب الملاحظة أن جهل القانون يؤدي من دون شك إلى أوضاع تسودها فترات اعتقالات تعسفية ومفرطة في الطول يقال إنها تؤدي إلى التعذيب وغيره من ضروب المعاملة السيئة.

The Special Rapporteur has observed that incidents of torture or other forms of illtreatment frequently occur in the period immediately following deprivation of liberty and during interrogation.
33- ولاحظ المقرر الخاص أن حالات التعذيب وغيره من أشكال سوء المعاملة غالباً ما تحدث في الفترة التي تلي مباشرة الحرمان من الحرية وأثناء الاستجواب.

5. During the period from 15 December 2007 to 14 December 2008, the Special Rapporteur sent 78 letters of allegations of torture to 48 Governments and 155 urgent appeals to 49 Governments on behalf of persons who might be at risk of torture or other forms of illtreatment.

The Committee recommends that the State party take appropriate measures to eradicate all forms of illtreatment by law enforcement officials and ensure prompt, thorough, independent and impartial investigations into all allegations of illtreatment, especially of members of ethnic groups and noncitizens; perpetrators should be prosecuted and punished, and victims granted compensation.
توصي اللجنة بأن تتخذ الدولة الطرف التدابير المناسبة للقضاء على جميع أشكال إساءة المعاملة التي يرتكبها الموظفون المكلفون بإنفاذ القانون وأن تكفل إجراء تحقيقات سريعة وشاملة ومستقلة ونزيهة في جميع الادعاءات التي تشير إلى إساءة المعاملة، وبخاصة إساءة معاملة أبناء الجماعات الإثنية وغير المواطنين؛ وينبغي ملاحقة مرتكبي هذه الأفعال ومعاقبتهم ومنح الضحايا تعويضاً.

67. The Optional Protocol creates a twopillar system, at the international and national levels, directed at preventing torture and other forms of illtreatment in all places of detention.
67- ويُوجِد البروتوكول الاختياري نظاماً ذا دعامتين على الصعيدين الدولي والوطني، موجهاً نحو منع التعذيب وغيره من ضروب إساءة المعاملة في جميع أماكن الاحتجاز.

The link between secret detention and torture and other forms of illtreatment is hence twofold: secret detention as such may constitute torture or cruel, inhuman and degrading treatment; and secret detention may be used to facilitate torture or cruel, inhuman and degrading treatment.
وعليه، فإن الصلة بين الاحتجاز السري والتعذيب وغيره من ضروب إساءة المعاملة ذات شقين هما: قد يشكل الاحتجاز السري في حد ذاته ضرباً من التعذيب أو المعاملة القاسية أو اللاإنسانية أو المهينة؛ وقد يستخدم الاحتجاز السري لتيسير ممارسة التعذيب أو المعاملة القاسية أو اللاإنسانية أو المهينة.

4. Secret detention and the absolute prohibition of torture and other forms of illtreatment

2.2 The complainants have submitted to the Committee a detailed description of the torture and other forms of illtreatment that they claim to have suffered.
