First, some human rights treaties expressly prohibit the expulsion of a person from the territory of the State of which he or she is a national.
فأولا، تحرم بعض معاهدات حقوق الإنسان صراحة طرد شخص من إقليم الدولة التي يحمل جنسيتها.

(a) The armed groups operating on/from the territory of the State party or with sanctuary on its territory;

(a) Ensure that migrant workers and members of their families are only expelled from the territory of the State party pursuant to a decision taken by the competent authority in conformity with the law;
(أ) العمل على ألا يطرد العمال المهاجرون وأفراد أسرهم من إقليم الدولة الطرف إلا بموجب قرار من السلطة المختصة وفقاً للقانون؛

(18) The Committee is concerned by the absence of a legal framework for the protection of migrants who do not satisfy the international refugee definition, but who face a real risk of death, torture or ill-treatment if expelled from the territory of the State party (arts. 6 and 7).

What distinguishes deportation or expulsion from the practice of renditions, however, is that they have a basis in national law and are preceded by an administrative process resulting in a decision which is notified to the person to be expelled or deported and can be challenged before a court. This opportunity to challenge the removal from the territory of the State is essential to uphold the principle of nonrefoulement.
غير أن ما يميز الترحيل أو الطرد عن عمليات الإعادة هو الأساس الذي تقوم عليه في القانون الوطني والعملية الإدارية التي تسبقها والتي تفضي إلى قرار يخطر به الشخص المزمع طرده أو ترحيله ويمكن الطعن فيه أمام محكمة وإمكانية الطعن في الطرد من أراضي الدولة أساسية لاحترام مبدأ عدم الطرد.

وطلب أحد اﻷعضاء مزيدا من اﻹيضاح للمادة ٤٠٦ من قانون العقوبات وطلب معلومات عما سيجري في شهر تشرين اﻷول/أكتوبــر عندمـا يترتـب على بعثة مراقبي اﻷمم المتحدة في السلفادور الانسحاب من أراضي الدولة الطرف.

It is, however, to be noted that article 3 (1) of Protocol No. 4 to the European Convention on Human Rights, 1963, provides that " No one shall be expelled, by means either of an individual or of a collective measure, from the territory of the State of which he is a national. "
ولكن تنبغي الإشارة إلى أن المادة 3 (1) من البروتوكول رقم 4 للاتفاقية الأوروبية لحقوق الإنسان، 1963، تنص على أن " لا يُطرد أحد بتدبير فردي أو جماعي من أراضي الدولة التي يكون أحد مواطنيها " .

(a) Migrant workers and members of their families are only expelled from the territory of the State party pursuant to a decision taken by the competent authority following a procedure established by law and in conformity with the Convention, and that this decision can be reviewed on appeal;
