وتشير اللجنة إلى أن اعتماد القانون رقم 1312 المؤرخ تموز/يوليه 2009 بشأن تطبيق مبدأ السلطة التقديرية للملاحقة يؤدي إلى الإفلات من العقاب عندما تُسقَط الدعوى القضائية دون مراعاة معايير حقوق الإنسان، ويمثل انتهاكاً لحق الضحية في الانتصاف الكامل.

Accordingly, it recommends that the Government of the Bolivarian Republic of Venezuela release Mr. López Mendoza forthwith and that it provide him with full redress, including moral and material compensation, as well as measures of satisfaction, such as a public statement of apology.
