Paragraph 35: The Committee recommends that the State party should take adequate legislative measures to adopt a definition of victim that complies with the definition set out in article 24, paragraph 1, of the Convention, recognizing a victim as any person who has suffered harm as the direct result of enforced disappearance, without requiring that such harm should also be personal.

كيفية التعبير في القانون المحلي عن التعريف الواسع ﻟ " الضحية " ، بحيث يشمل الشخص المختفي وأي فرد لحق به ضرر مباشر من جراء الاختفاء القسري؛

Furthermore, please specify whether domestic law provides for all the forms of reparation enshrined in article 24, paragraph 5, of the Convention for persons who have suffered harm as the direct result of an enforced disappearance (art. 24).
وعلاوة على ذلك، يرجى تحديد ما إذا كان القانون المحلي ينص على جميع أشكال التعويض الواردة في الفقرة 5 من المادة 24، من الاتفاقية للأشخاص الذين لحق بهم ضرر مباشر من جراء الاختفاء القسري (المادة 24).

143. Accordingly, adoption of the definition contained in article 24, paragraph 1 ( " For the purposes of this Convention, `victim'means the disappeared person and any individual who has suffered harm as the direct result of an enforced disappearance " ), will necessitate consideration of the amendment of the Iraqi legal system in regard to criminal acts of enforced disappearance.
143- وعلى هذا الأساس فان الأخذ بالتعريف الوارد في المادة 24/1 " لأغراض هذه الاتفاقية، يقصد ﺑ `الضحية` الشخص المختفي وكل شخص طبيعي لحق به ضرر مباشر من جراء هذا الاختفاء القسري " يقتضي البحث في تعديل منظومة التشريعات العراقية ذات العلاقة بجريمة الاختفاء القسري.

35. Please indicate whether, besides compensation, the legislation provides for other forms of reparation for persons who have suffered harm as the direct result of an enforced disappearance, such as rehabilitation, satisfaction and guarantees of non-repetition.
٢٤- ويرجى بيان ما إذا كانت التشريعات تنص، إلى جانب التعويضات، على أشكال أخرى لجبر ضرر الأشخاص الذين لحقهم ضرر مباشر جرّاء اختفاء قسري، مثل إعادة التأهيل والترضية وضمانات عدم التكرار.

39. CED was concerned that reparatory measures might not benefit all those persons who had suffered harm as the direct result of an enforced disappearance.
٣٩- وأعربت اللجنة المعنية بالاختفاء القسري عن قلقها لأن جميع الأشخاص الذين لحقهم ضرر مباشر جرّاء اختفاء قسري قد لا يستفيدون من تدابير الجبر.
