(a) The main paragraph of article 4 limits the subjects to be condemned by the States parties to all propaganda, etc. which is based on ideas or theories of superiority of one race, etc., or which attempt to justify or promote racial hatred and discrimination.

1. States parties shall, in accordance with human rights standards, declare illegal and prohibit all organizations based on ideas or theories of superiority of one race or group of persons of one colour or ethnic origin, or which attempt to justify or promote national, racial and religious hatred and discrimination in any form.
1- تعلن الدول الأطراف، طبقا لمعايير حقوق الإنسان، عدم قانونية جميع المنظمات القائمة على الأفكار أو النظريات القائلة بتفوق عرق أو مجموعة أشخاص من لون أو أصل إثني واحد، أو التي تحاول تبرير أو تعزيز أي شكل من أشكال الكراهية والتمييز على أساس قومي وعنصري وديني، وتحظر هذه المنظمات.

In this context, it should be noted that article 4 of the International Convention on the Elimination of All Forms of Racial Discrimination obliges States Parties to condemn all propaganda and any organizations that are based on ideas or theories of the superiority of one race or group of persons of one colour or ethnic origin, or which attempt to justify or promote racial hatred and discrimination in any form.

11. In the chapeau and subparagraph (a), regarding " ideas or theories of superiority " or " racial superiority or hatred " respectively, the term " based on " is employed to characterize speech impugned by the Convention.

Under the terms of this article, States parties undertake to prevent, prohibit and condemn all propaganda and all organizations which are based on ideas or theories of superiority of one race or group of persons of one colour or ethnic origin or which attempt to justify or promote racial hatred and discrimination in any form, and also undertake to declare illegal, and punish, such propaganda or organizations.

States, in accordance with their human rights obligations, to declare illegal and to prohibit all organizations based on ideas or theories of superiority of one race or group of persons of one colour or ethnic origin, or which attempt to justify or promote national, racial and religious hatred and discrimination in any form, and to adopt immediate and positive measures designed to eradicate all incitement to, or acts of, such discrimination;

Article 3 of the 1988 law provides penalties ranging from one month to three years of imprisonment for persons belonging to organizations which or who engage in propaganda based on ideas or theories of racial or other superiority aimed at justifying or promoting racial and religious discrimination.

24. As stipulated by the Convention, the promotion of ideas or theories of the superiority of one race or group, and of ideas or theories which attempted to justify or promote racial hatred and discrimination in any form must be condemned.
