3.1 The complainant claims that he would be in danger of being subjected to torture in violation of article 3 of the Convention if deported to his country of origin.
3-1 يدعي صاحب البلاغ أنه قد يتعرض لخطر التعذيب في انتهاك للمادة 3 من الاتفاقية إذا طُرد إلى بلده الأصلي.

Despite the presumed senior role of L.D.Z. in the Tien Tao religion, the fact that she was able to enter and leave China without being subjected to torture indicates that the complainant, who does not hold a prominent role in the religion, would not risk being subjected to torture if deported to China.

5.2 The State party is of the opinion that the Committee should only use the procedure under rule 108, paragraph 9, when there is a prima facie important and serious risk that someone would be subjected to torture if deported.

4.5 With regard to the concern raised by the complainant that he risks persecution if deported to the Congo, the State party recalls that peace agreements were signed in December 1999 between Sassou Nguessou's new Administration and the opposition militias.

8.8 In the light of the information provided by the parties, the Committee finds that the complainant has not substantiated a causal link between the events that ostensibly led him and his children to leave their country of origin and the risk of torture that they would face if deported to the Democratic Republic of the Congo.
8-8 وفي ضوء المعلومات المقدمة من الطرفين، ترى اللجنة أن صاحب الشكوى لم يثبت وجود علاقة سببية بين الأحداث التي دفعته هو وطفليه إلى مغادرة بلدهم الأصلي، وبين خطر التعرض للتعذيب في حالة عودتهم إلى جمهورية الكونغو الديمقراطية.

3. The complainant claims that her deportation to Turkey would violate article 3 of the Convention, as there are substantial grounds for believing that, if deported, she would be subjected to torture or other inhuman treatment and forced to confess guilt.

The State party recalls the criteria established by the Committee in its general comment No. 1 (1997) on the implementation of article 3 of the Convention in the context of article 22 which require the complainant to prove that he or she runs a personal, present and substantial danger of torture if deported to his or her country of origin.

3.5 In a further submission, dated 28 November 2011, the complainants provided additional documentation in order to demonstrate the " imminent risk of torture " they claim to face if deported to the Islamic Republic of Iran.
