2.1 On 28 October 2002, Tashkent city court found Mr. Gougnin, Mr. Karimov and a certain Ismailov guilty of planning and carrying out an armed attack in the flat of a certain Chakirov on 8 April 2002 with the aim of stealing money.

Mr. Mamyrov (Kyrgyzstan) said that inquiries into the circumstances of the death of Mr. Ismailov had been reopened and were ongoing.

2.1 From 2002 to 2005, Mr. Ismailov served in the Ministry of Defence as Head of the Central Intelligence Department of the Joint Staff of the Armed Forces of Uzbekistan.
2-1 كان السيد إسماعيلوف يعمل في وزارة الدفاع رئيساً لإدارة الاستخبارات المركزية في هيئة الأركان المشتركة للقوات المسلحة الأوزبكية في الفترة الممتدة من عام 2002 إلى عام 2005.

2.4 On 5 February 2007, Mr. Ismailov filed a cassation appeal to the Judicial Chamber of the Military Court of the Republic of Uzbekistan.
2-4 وفي 5 شباط/فبراير 2007، رفع السيد إسماعيلوف دعوى نقض أمام الدائرة القضائية التابعة للمحكمة العسكرية لجمهورية أوزبكستان.

However, all these complaints were redirected to the Prosecutor's Office and dismissed, without any explanations as to the lawfulness of Mr. Ismailov's arrest and conviction.
غير أن كل هذه الشكاوى أحيلت إلى النيابة العامة ورفضت، دون أي توضيح لقانونية إلقاء القبض على السيد إسماعيلوف وإدانته().

Thereby, the accusation restricted Mr. Ismailov's constitutional and procedural rights to appeal against the acts and decisions of the investigator, including against the decision in relation to his illegal arrest, due to the fact that he was prevented from having the assistance of a lawyer of his own choosing for the preparation of the respective appeals.
وهكذا، فإن الاتهام قيّد حقوق السيد إسماعيلوف الدستورية والإجرائية في أن يطعن في إجراءات المحقق وقراراته، بما فيها قراره المتعلق بإلقاء القبض عليه بصورة غير مشروعة، لأنه منع من توكيل محام يختاره بنفسه لإعداد الطعون.
