The State in the territory of which an alleged offender is found has the duty either to extradite that person to one of the States having a connection to the crime or to submit the case to its competent authorities for the purpose of prosecution.
ومن واجب الدولة التي يعثر في أراضيها على متهم بارتكاب جريمة أن تسلمه الى إحدى الدول التي لها صلة بالجريمة أو تحيل القضية الى السلطات المختصة فيها ﻹقامة الدعوى.

(c) in the case of the Enterprise, by its competent authority.

5. If an extradition request is made with respect to an offence described in article 3.1 and if the requested State Party does not or will not extradite, on the basis of the nationality of the offender, that State shall take suitable measures to submit the case to its competent authorities for the purpose of prosecution.
5 - إذا ما قُدم طلب لتسليم مجرم فيما يتعلق بجريمة من الجرائم الوارد ذكرها في المادة 3-1 وإذا ما كانت الدولة الطرف المتلقية للطلب لا تسلم أو لن تسلم المجرم، استناداً إلى جنسية المجرم يجب على تلك الدولة أن تتخذ التدابير الملائمة لعرض الحالة على السلطات المختصة فيها لغرض المقاضاة.

5 - إذا ما قدم طلب لتسليم مجرم فيما يتعلق بجريمة من الجرائم الوارد ذكرها في الفقرة 1 من المادة 3 وإذا كانت الدولة الطرف المتلقية للطلب لا تسلم أو لن تسلم المجرم، استنادا إلى جنسية المجرم، يجب على الدولة أن تتخذ التدابير الملائمة لعرض الحالة على السلطات المختصة فيها لغرض المقاضاة.
