بيد أن اللجنة تذكر أن " فرض عقوبة الإعدام فرضاً إلزامياً بموجب قوانين الدولة الطرف يرتكز فقط على فئة الجرائم التي يتبين أن الجانب مذنب فيها " وأن " عقوبة الإعدام إلزامية في جميع حالات القتل العمد " .

7.3 As to the author's claim under article 6 of the Covenant, the Committee notes that her husband was sentenced to death for having committed a particularly serious crime, that is classified as such under the laws of the State party, by the judgment of the Supreme Court of Karakalpakstan, and that this death sentence was subsequently confirmed by a higher court.
7-3 أمّا فيما يخص ادعاء صاحبة البلاغ بموجب المادة 6 من العهد، فتشير اللجنة إلى أنه قد حُكم على زوجها بالإعدام لكونه ارتكب جريمة شديدة الخطورة، وهي جريمة مصنفة كذلك في قوانين الدولة الطرف بموجب حكمٍ صادر عن محكمة كاراكالبكستان العليا، وهو حكم أكدته محكمةً أعلى درجةً في مرحلة لاحقة.

219. The Committee notes with satisfaction that the laws of the State party prohibit the withholding of passports of migrant workers, prohibit employment agencies from collecting fees from migrant workers, and allow migrant workers to change employers without losing their work permit.
219- وتلاحظ اللجنة بارتياح أن قوانين الدولة الطرف تحظر احتجاز جوازات سفر العمال المهاجرين، وتحظر قيام وكالات التوظيف بتحصيل رسوم من العمال المهاجرين، وتسمح للعمال المهاجرين بتغيير أصحاب العمل دون فقدان تصاريح عملهم.

Article VIII of the Convention stipulated that any person taken into custody must be guaranteed fair treatment, including the enjoyment of all rights and guarantees in conformity with the laws of the State party in the territory of which that person was present and with the applicable provisions of international law, including international human rights law.
وتنص المادة الثامنة من الاتفاقية على أن أي شخص يتم احتجازه ينبغي أن تؤمن له معاملة عادلة، بما في ذلك التمتع بجميع الحقوق والضمانات وفقا لقوانين الدولة الطرف في الإقليم الذي يوجد به هذا الشخص ووفقا للأحكام المطبقة من القانون الدولي، بما في ذلك القانون الدولي لحقوق الإنسان.

(d) Ensure effective enforcement of the laws of the State party declaring illegal parties or organizations which promote or incite racial discrimination, in conformity with article 4 (b) of the Convention.
