19- تلاحظ اللجنة مع القلق أن تشريعات الدولة الطرف لا تتضمن أحكاماً محددة تحظر تصدير الأسلحة من الدولة الطرف إلى البلدان التي هي في حالة نزاع، حيث يمكن تجنيد الأطفال أو استخدامهم في أعمال القتال.

While taking note that there are ongoing discussions in the State party concerning the drafting of a Discrimination Prohibition Law, the Committee nevertheless remains concerned that the legislation of the State party does not seem to respond fully to the requirements of article 4 of the Convention.
494- وإذ تحيط اللجنة علما بالمناقشات الجارية في الدولة الطرف بشأن صياغة قانون لحظر التمييز، لا يزال يراودها الشعور بالقلق لأن تشريعات الدولة الطرف لا تستجيب، على ما يبدو، استجابة كاملة، لمقتضيات المادة 4 من الاتفاقية.

108. The Committee expresses concern that the legislation of the State party does not contain either a definition of discrimination against women, in accordance with article 1 of the Convention, or the principle of equality of men and women, in line with article 2 (a) of the Convention.
108 - تعرب اللجنة عن القلق لأن تشريعات الدولة الطرف لا تعرّف التمييز ضد المرأة وفقا للمادة 1 من الاتفاقية، ولا تنص على مبدأ المساواة بين الرجل والمرأة تمشيا مع أحكام المادة 2 (أ) من الاتفاقية.

422. The Committee is concerned that the legislation of the State party does not provide for the criminalization of domestic violence and marital rape and does not prohibit corporal punishment in the home (art. 10).
422- وتشعر اللجنة بالقلق لأن تشريعات الدولة الطرف لا تنص على تجريم العنف المنزلي والاغتصاب الزوجي ولا تحظر العقاب البدني في المنزل (المادة 10).

The Committee is also concerned that the legislation of the State party does not criminalize the sale of children as required by article 3(1)(a)(ii) of the Optional Protocol.
وتعرب اللجنة عن قلقها أيضاً لأن تشريعات الدولة الطرف لا تجرّم بيع الأطفال على نحو ما تقتضيه المادة 3(1)(أ)`2` من البروتوكول الاختياري.

22. The Committee is concerned that the legislation of the State party does not provide for the criminalization of domestic violence and marital rape and does not prohibit corporal punishment in the home (art. 10).
22- وتشعر اللجنة بالقلق لأن تشريعات الدولة الطرف لا تنص على تجريم العنف المنزلي والاغتصاب في إطار الزواج ولا تحظر العقاب البدني في المنزل (المادة 10).

While noting that the dissemination or expression of racist ideas can constitute defamation and other crimes under the Penal Code, the Committee is concerned that the legislation of the State party does not fully comply with all provisions of article 4 of the Convention (art. 4).
وفي حين تلاحظ اللجنة أن نشر أفكار عنصرية أو التعبير عنها يمكن أن يشكل جريمة تشهير وجرائم أخرى بموجب القانون الجنائي، فإنها تشعر بالقلق لأن تشريعات الدولة الطرف لا تمتثل جميع أحكام المادة 4 من الاتفاقية امتثالاً تاماً (المادة 4).

While noting that the State party's Constitution accords primacy to international instruments over domestic laws and that, according to the State party's statement, provisions of international treaties have been invoked in courts, the Committee remains concerned that as many provisions of the Convention are not self-executing, the legislation of the State party does not currently give full effect to all articles of the Convention.
8- وفيما تلاحظ اللجنة أن دستور الدولة الطرف يعطي الأسبقية للصكوك الدولية على القوانين الداخلية وأن المحاكم تحتج في قراراتها بأحكام المعاهدات الدولية، حسبما ما ورد في بيان الدولة الطرف، فلا يزال يساورها القلق لأن تشريع الدولة الطرف لا يتيح حالياً الإنفاذ الكامل لجميع مواد الاتفاقية، بحكم أن الكثير من أحكامها لا تنفّذ بشكل تلقائي.
