That situation constitutes a violation of the obligation of Israel to protect the right to life and to physical integrity of the Palestinian people and to maintain public order in the occupied territory.

2. Such issues would include guarantees of a fair trial, the independence of the judiciary and other legal professionals, respect for lawful arrest and detention procedures, safeguards for the right to life and to physical integrity, and popular access to effective remedies for human rights violations.

(f) Right to life and to physical integrity

It is appropriate, therefore, that the Commission should classify the seriousness of each " act of violence " on the basis of the rights which the two instruments list as not being subject to derogation, in particular, rights related directly to the right to life and to physical integrity.
جسامة كل " عمل من أعمال العنف " على أساس قائمة الحقوق غير القابلة للتقييد التي ترد في المعاهدتين. ولا بد بوجه خاص من أن تؤخذ في الاعتبار الحقوق التي تتصل مباشرة بالحق في الحياة والسلامة البدنية للفرد.

According to this criteria, non-derogable rights include the right to life and to physical integrity, freedom from slavery and forced labour and freedom from " persecution " based on racial, religious, social, political or cultural motives.

(أ) أن ينهوا دون تأخير أي انتهاك لحقوق المدنيين في الحياة والسلامة البدنية والأمن دون أي تمييز على أساس الجنس أو السن أو الأصل الإثني أو الدين، وأن يمسكوا عن إعاقة جهود تقديم المساعدة الطبية والقانونية أو التعويضات إلى ضحايا انتهاكات حقوق الإنسان والاعتداءات؛

It has also been found that it is in such situations that inalienable rights are most frequently infringed - in particular the right to life and to physical integrity - and that a pattern of gross and systematic human rights violations occur in the largest number of countries.
وقد تبين أيضا أنه في حالات من هذا القبيل يُتعدى في أكثر اﻷحيان على الحقوق غير القابلة للتصرف - ولا سيما الحق في الحياة وفي السلامة البدنية - وتحدث انتهاكات جسيمة ومنهجية لحقوق اﻹنسان في العدد اﻷكبر من البلدان)١(.

3. The serious violations of the right to life and to physical integrity listed in this addendum are closely linked to the further developments in the crisis in Burundi caused by the interruption of the transition to democracy following the assassination of President Ndadaye on 21 October 1993, the acts of genocide perpetrated against the Tutsis and the subsequent massacres of Hutus.
٣- للاعتداءات الجسيمة على الحق في الحياة وفي السلامة الجسدية الوارد سردها في هذه اﻹضافة صلة وثيقة لنتائج اﻷزمة البوروندية التي أحدثها توقف عملية الانتقال إلى الديمقراطية، على إثر اغتيال الرئيس ندداي في ١٢ تشرين اﻷول/أكتوبر ٣٩٩١، وأفعال اﻹبادة الجماعية التي ارتكبت ضد التوتسي ومذابح الهوتو التي تعاقبت.

In conformity with paragraph 11 (a) of its revised methods of work (see annex I), the Working Group, without in any way prejudging the final assessment of whether the detention was arbitrary or not, drew the attention of each of the Governments concerned to the specific case as reported and appealed to it to take the necessary measures to ensure that the detained persons' rights to life and to physical integrity were respected.
